PLEASE SUBSTITUTE FOR COPY <br />02' Ordinance 56-67 supplied <br />with Docket of October 2,1967 <br /> <br />ORDINANCE NO. 56-67 <br /> <br />BY: <br /> <br /> AN EMERGENCY ORDINANCE to supplement the <br />Traffic Code of the codified Ordinances of the City of <br />Lakewood~ Ohio, by enacting new Sections 775.01 to 775.04 <br />relating to the operation of motorcycles. <br /> <br /> ~THEREAS~ This ordinance constitutes an <br />emergency measure provmding for the usual daily operation of <br />a municipal department and for the immediate preservation <br />of the put~lic safety and welfare; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Traffic Code of the <br />Codified Ordinances of the City of Lakewood be and the same <br />is hereby supplemented by enacting new Sections 775.01 to <br />775.04, inclusive, to read as follows: <br /> <br />Section 775.01 Motorcycle, defined <br /> <br />"Motorcycle" means every motor vehicle other than a <br />tractor having a saddle for the use of the operator <br />and designed to travel on not more than three wheels <br />in contact with the ground, including, but not limited <br />to, motor vehicles known as "motor-driven cycle," <br />"motor bicycle,""motor scooter," "bicycle with motor <br />attached~" or "motorcycle" without regard to weight <br />or brake horsepower. <br /> <br />Scection 775°.02 gxhaust Eq(uipment <br /> <br />Every motorcycle with an internal combustion engine <br />shall at all times be equipped wlth a muffler which <br />is in good working order and in co~]stant operation to <br />prevent excessive or unusual noise~ and no person <br />shall use a muffler Cutout, by-pass,or similar device <br />upon a motorcycle within the City of Lakewood. Every <br />motorcycle muffler shall be equipped with baffle <br />.plates. <br /> <br />No person shall own~ operate~ or have in his possession <br />any motorcycle equipped with a device for producing <br />excessive smoke or gas~ or so equipped as to permit oil <br />or any other chemical to flow into or upon the exhaust <br />pipe or muffler of such motorcycle, or equipped in any <br />other way to produce or emit smoke or dangerous or <br />annoying gases from any portion of such motorcycle, <br />other than the ordinary gases emitted by the exhaust <br />of an internal combustion engine under normal operation. <br /> <br /> <br />
