ORDI~L%NCE NO. 5-68 BY: Messrs. Graber, Huffman, Kelley, Usher, Ward, Gaydos AN EMERGENCY ORDINANCE zr~ng permission to Bonne Bell, Inc., 18515 Detroit Avenue in the City of Lakewood to construct a building on the south side of Datroit Avenue northerly of the present 25 foot set-back line alon~ the southerly line of Detroit Avenue. WHEREAS, by Ordinance No. 70-63 adopte~ October 7, 1963, the Building Line Map was amended so as to establish building set-back lines along Detroit Avenue in. the City of Lakewood, such building set-back lines being 25 feet southerly and northerly of the southerly and northerly street lines of DetrOit Avenue, and, WHEREAS, by Ordinance 1-52 adopted August 20, 1952, this Council has the power to authorize construct'ion beyond said building set-back lines in instances where appropriate improvement to property cannot be secured without building beyond the established building line, and, WHEREAS, this Council determines that in order to secure appropriate improvement of the property located at 18523-25 Detroit Avenue, further known as Permanent Parcel No. 311-18-92, it is necessary to construct a building beyond the present set-back line, and, WHEREAS, an emergency exists in that it is deemed necessary to authorize the issuance of a construction permit forthwith in order to provide for the public convenience, and the health, safety and welfare of the City and its inhabitants; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That this Council hereby grants permission to Bonne Bell, Inc. to construct a building at 18523-25 Detroit Avenue and in so doing to encroach beyond the existing building set-back line a distance of 25 feet. Section 2. That the Mayor be and he is hereby authorized and directed on behalf of the City of Lakewood and this Council to issue a construction permit to Bonne Bell, Inc. for construction of additional facilities at 18523-25 Detroit Avenue in the City of Lakewood, further known as Permanent Parcel No. 3i!-18-92. Section 3. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
