Hu££man, Kelley, Ushez, <br /> 13-65 Nard, Wendling, Caydos, <br /> <br /> ~ ~RGENCY 0~IN~CE to le~ special assessments for the ~prov~ent <br />of Abbieshire Avenue in the City of L~ewood, Ohio, between certain te~ini <br />by the 'necess~ grading of the base, resurfacing with ~sph~tic concrete <br />including the necess~y replacement ~d resetting of castings and the <br />necess~ resetting and replacing of c~bs together with the necessa~ <br />~pp~en~ces thereto. <br /> %~, this Co~cil by two-thirds vote of the members elected thereto <br />dete~ines that this ordin~ce is an emergency measure which is necessa~ for <br />the i~ediate preservation of the public peace, property, health mnd safety <br />~d for the ~ther reason that the assessments herein provided for must be <br />pr~ptly levied in omder to retire outSt~ding notes by the issu~ce of bonds <br />~d thereby prese~e the credit of the City. <br /> NOW, TH~ORE, BE IT O~AIN~ by the Co~cil of the City of L~ewood, <br /> Cuy~oga Co~ty, State of Ohio: <br /> <br /> Section 1. ~at the assessment of the cost ~d expense of ~proving <br /> Abbieshire Avenue from Lake Avenue to Edgewater Drive in the City of <br /> L~ewood, Ohio, by the necess~y ~ading of the base, resurfacing with <br /> asph~tic concrete including the necess~y replacement and resetting <br /> of castings ~d the necessa~ resetting and replacing of curbs together <br /> with the necessa~ app~tenances thereto as set fo~h in Resolution No. <br /> ~5~2 adopted by this Co~cil on Febru~ 20, 1967 ~d ~o~ting in the <br /> ~egate to $2,7~5.15 as reported to this Co, oil on the first day of <br /> April, 1968, by the Director of Fin~ce, be and the s~e is hereby adopted <br /> ~d confi~ed, ~d that there be ~d are hereby levied ~d assessed upon <br /> the lots ~d l~ds ~un~ng and abutting upon said improvement the several <br /> ~o~ts reposed as aforesaid, which ~sessments and the description of smid <br /> lots and l~ds ~e n°~r on file in the office of the Clerk of Co~cil and <br /> which assessments are in proportion to the special benefits, ~d ~e not <br /> in excess of ~y statuto~ limitation. <br /> <br /> Section 2. That the total ~sessment ~ainst each lot or p~cel of land <br /> sh~l be payable in cash not later th~ May l, 1968, or at the option of the <br /> o~er, in ten semi-~nual instalments with interest at the s~e rate as shall <br /> be borne by the bonds to be issued in ~ticipati~ of the collection of the <br /> s~e. All cash pa~ents shall be ~de to the Director of Finance of said City. <br /> All assessments ~d inst~ents thereof remaining ~paid at the expiration of <br /> said period shall be certified by the Director of Fin~ce to the Co~ty Audi- <br /> tor as provided by law to be placed by him on the t~ duplicate ~d collected <br /> as other t~es are collected. <br /> <br /> Section B. ~is ordin~ce, having been dete~ined to be an emergency <br /> measure, sh~l be in ~ll force and effect from ~d ~ediately after its <br /> pass~e and approval by the Mayor. <br /> <br />Passed: <br /> <br />AprL1 1, 1968 <br /> <br />Robert E.
