Kelley, Usher, Ward, <br />Wendliug, Gaydos, Graber, <br />Huffman <br /> <br /> AN EMERGENCY ORDI~ANCE to amend Section 371.06 of the <br />Traffic Code of the Codified Ordinances of the City of Lakewood, <br />Ohio, relating to soliciting rides and prohibited riding. <br /> <br /> WHEREAS, This ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public safety <br />and welfare and for the usual daily operation of a municipal <br />department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That Section 371.06 of the Traffic Code of <br />the Codified Ordinances of the City of Lakewood, now reading as <br />follows: <br /> <br />Section 371.06 Soliciting Rides; Prohibited Riding <br /> <br />"(a) No person while on a street outside of a safety zone <br /> shall solicit a ride from the driver of any vehicle. <br /> <br />(b) No person shall hang onto, or ride on the outside of, <br />the rear end of any motor vehicle, while moving upon a <br />street except mechanics or test engineers making repairs <br />or adjustments. <br /> <br />(c) No operator shall knowingly permit any person to hang <br />onto, or ride on the outside, of any motor vehicle, while <br />moving upon a street, except mechanics or test engineers <br />making repairs or adjustments." <br /> <br />be and the same hereby is amended to read as follows: <br /> <br />Section 371.06 Soliciting Rides; Prohibited Riding <br /> <br />(a) No person while on any roadway, tree lawn, sidewalk <br />or land contiguous thereto, within the City, shall solicit <br />a ride from the driver of any private vehicle. <br /> <br />(b) No person shall hang onto, or ride on the outside of, <br />the rear end of any motor vehicle, while moving upon a <br />street except mechanics or test engineers making repairs <br />or adjustments. <br /> <br />(c) No operator shall knowingly permit any person to hang <br />onto, or ride on the outside of, any motor vehicle, while <br />moving upon a street, except mechanics or test engineers <br />making repairs or adjustments. <br /> <br />(d) None of the provisions of this section shall be <br />construed to prevent any person upon a public highway from <br />soliciting transportation where an emergency actually <br />exists, nor shall this section be construed to prevent any <br />person from signaling or requesting transportation from a <br />passenger carrier for the purpose of becoming a passenger <br />thereon for hire. <br /> <br /> <br />
