Gaydos, Graber, <br />Huffm~n, Kelley, Usher, <br />Ward, %~endling <br /> <br /> AN E}-~RGENCY ORDINANCE to enact new Chapter 155 of the <br />Administrative Code of the Codified Ordinances of the City of <br />Lakewood, entitled Sale or Lease of Real Property, relating to the <br />establishment of a procedure for the sale or lease of municipally <br />owned real property, having a fair market value of $500.00 or <br />less, no longer needed for any municipal purpose, without competi- <br />tive bidding, and repealing Section 107.08 of said Administrative <br />Code. <br /> <br /> WHEREAS, It is necessary to provide for a proper procedure <br />for the sale or lease of municipally owned real property having a <br />fair market value of $500~00 or less, no longer needed for a <br />municipal purpose, and, <br /> <br /> WH4EREAS, This ordinance cOnstitutes an emergency measure <br />providing for the immediate preservation of the public health, <br />safety and welfare and for the usual daily operation of a municipal <br />department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> SeCtion 1. That the Administrative Code of the Codified <br />Ordinances of the City of Lakewood be and the same is hereby <br />supplemented by enacting a new Chapter 155, to read as follows: <br /> <br /> CHAPTER 155 <br />Sale or Lease of Real Property <br /> <br />155.01 Procedure <br /> <br />Section 155.01 Procedure <br /> Real estate belonging to the City of Lakewood, having <br />a fair market value of $500.00 or less, may be sold or <br />leased when so directed by the Board of Control and pur- <br />suant to an ordinance of Council setting forth the <br />following: <br /> <br /> (a) A description of the real property to be sold or <br /> leased; <br /> <br /> (b) A finding that said real property is no longer <br /> needed for any municipal purpose; <br /> <br /> (c) The reason for selling or leasing said real property; <br /> <br /> (d) The kind of conveyance or lease to be given by the <br /> City of Lakewood; and <br /> <br /> (e) The consideration to be paid therefor. <br /> <br /> When the sale is so authorized, the Mayor, without <br />further proceedings, shall execute a deed or lease to <br />the purchaser or lessee of such real property provided <br />that such purchaser or lessee shall have first been <br />approved on motion of the Council adopted by a majority <br />vote of the members elected thereto. <br /> <br /> Section 2. That this ordinance is hereby declared to be <br />an emergency measure for the reasons stated in the preamble hereof <br />and provided it receives the affirmative vote of ~.~o-thirds of all <br />members elected to Council, it shall take effect and be in force <br />immediately upon its adoption and approval by the Mayor, and <br />existing Section 107.08 of the Administrative Code shall be and <br />is hereby repealed. <br /> <br />Adopted: September 16, !968 Robert E.
