ORDINANCE NO. 74-68' <br /> <br />BY: Messrs. Gaydos, Huffman, Kelley, <br /> Usher, Wendling, Graber <br /> <br /> AN EMERGENCY ORDINANCE directing and authorizing the <br />Mayor on behalf of the CitY of Lakewood to enter into a contract <br />with The Industrial Commission of Ohio, to provide coverage <br />under the Workmen's Compensation Act for auxiliary policemen. <br /> <br /> WHEREAS, The City of Lakewood has secured, and from <br />time to time desires to secure, the services of a group of <br />persons as auxiliary policemen under such circumstances and <br />terms that the individual members thereof are not and will not <br />become employees of the City as defined in Division (A) (1) of <br />Section 4123.01 of the Revised Code of Ohio; and, <br /> <br /> WHEREAS, The City desires to secure, and Revised Code <br />Section 4'123.03 authorizes it to secure, workmen's compensation <br />in respect to such individuals in the event of injury, disease <br />or death while engaged in activities called for by such service; <br />and, <br /> <br /> WHEREAS, To secure such workmen's compensation it is <br />necessary for the City to enter into a Contract with The <br />Industrial commission of Ohio; and, <br /> <br /> WHEREAS, This ordinance constitutes an emergency <br />for the reasons that the persons who are now engaged and who <br />may hereafter engage in such services may incur injury, disease <br />or death while in the performance of such services requiring <br />such immediate protection as is afforded by the Workmen's <br />Compensation Act, and that it provides for the public welfare <br />and safety and the usual daily operation of a municipal depart- <br />ment; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be, and he is hereby <br />authorized and directed to enter into a Contract with The <br />Industrial Commission of Ohio, in ~the form prepared and sub- <br />mitted by the Industrial Commission with such insertions therein <br />as may be necessary, so as to provide workmen's compensation <br />coverage to auxiliary policemen in accordance with Revised Code <br />Section 4123.03. <br /> <br /> Section 2. The premiums necessary for such workmen's <br /> compensation coverage as required by the Contract hereinbefore <br /> authorized shall be deducted by the.County Auditor in the same <br /> manner as is provided for all other employees of the City now <br /> covered by Workmen's Compensation; and all officials and <br /> employees of the City are hereby authorized and directed to <br /> make such reports, perform such acts, and do such things as may <br /> be necessary to carry out the terms of said Contract so as to <br /> assure the workmen's compensation coverage as therein and herein <br /> provided. <br /> <br /> .seCt~O'n 3..
