ORDINANCE NO. 82-68 BY: Gaydos, Graber, Huffman, <br /> Kelley, Usher, Ward, <br /> Wendling <br /> AN EMERGENCY ORDINANCE granting permission %o Detroit <br />Automatic Car Wash, Inc.~ 18425 Detroit Avenue in ~e City of <br />Lakewood to construct an addition at the east end of an existing <br />building (but not to include the northerly side of the existing <br />building) on the south side of Detroit Avenue northerly of the <br />present 25 foot set-back line along the southerly line of' <br />Detroit Avenue. <br /> <br /> WHEREAS, By Ordinance No. 70-63, adopted October 7, 1963, <br />the Building Line Map was amended so as to establish building <br />set-back lines along Detroit Avenue in the City of Lakewood, such <br />building set-back lines being 25 feet southerly and northerly of <br />the southerly and northerly street lines of Detroit Avenue, and, <br /> <br /> WHEREAS, By Ordinance 1-52, adopted August 20° 1952, this <br />Council has the power to authorize construction beyond said build- <br />ing set-back lines in instances where appropriate improvement to <br />property cannot be secured without building beyond the established <br />building line, and~ <br /> <br /> WHEREAS, This Council determines that in order to secure <br />appropriate improvement of the property located at 18425 Detroit <br />Avenue, further known as Permanent Parcel NOo 311-19-1, it is <br />necessary to construct an addition to an existing building beyond <br />the present set-back line, and, <br /> <br /> WHEREAS, An emergency exists in that it is deemed necessary <br />to authorize the issuance of a construction permit forthwith in <br />order to provide for the public convenience, and the health, <br />safety and welfare of the City and its inhabitants;now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That this Council hereby grants permission to <br />Detroit Automatic Car Wash, Inc. to construct an addition at the <br />east end of an existing building (but not to include the northerly <br />side of the existing building) at 18425 Detroit Avenue and in so <br />doing to encroach beyond the existing building set-back line but no~ <br />greater than within 10 feet of existing sidewalks. <br /> <br /> Section 2o That the Mayor be and he is hereby authorized <br />and directed on behalf of the City of Lakewood and this Council to <br />issue an appropriate construction permit to Detroit Automatic Car <br />Wash, Inc. for construction of said addition at 18425 Detroit <br />Avenue in the City of Lakewood, further known as Permanet Parcel <br />No. 311-19-1. <br /> <br /> Section 3. That this ordinance is hereby declared to be <br />an emergency measure for the reasons stated'in the preamble hereof <br />and provided it receives the affirmative vote of two-thirds of all <br />members elected to Council~ it shall take effect and be in force <br />immediately upon its adoption and approval by the Mayor. <br /> <br />Adopted: ..... .November 18~... 196,8 <br /> <br />Robert E.
