ORDINANCE NO. <br /> <br />88-68 <br /> <br />BY: Messrs. Huffman, Kelley, Usher: <br /> Wendling, Gaydos, Graber <br /> <br /> AN E~RGENC¥ ORDINANCE authorizing settlement of <br />the claim of Matilda Hahn, not n~arried, in the total amount <br />of Three Hundre~ Dollars ($300.00)~ arising out of an <br />accident when she fell on the public sidewalk in front of <br />15721 Clifton Boulevard in the City of Lakewood Ohio on <br />January 6~ 1963. ' ' <br /> <br /> WHEREAS, This ordinance constitutes an emergency <br />in that it may save the City from further expense and a <br />possible substantial jury verdict rendered against the City <br />and in that it provides for the usual daily operation of a <br />municipal department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That settlement of the claim of <br />Matilda Hahn, in the amount of Three Hundred Dollars <br /> ($300.00), is hereby ordered and authorized, conditioned <br />upon the execution and delivery by Matilda Hahn of a full <br />release in favor of the City of Lakewood, duly approved by <br />the Director of Law. <br /> <br /> Section 2. That the Director of Finance be and <br />he is hereby authorized to pay the sum of Three Hundred Dollars <br />($300.00) to Matilda Hahn, upon delivery to the Director of <br />Finance of the foregoing release duly executed and approved~ <br />and to charge the same to the General Fund - Damages paid by <br />the City. <br /> <br /> Section 3. That this ordinance is hereby declared <br />to be an emergency measure for the reasons stated in the <br />preamble hereof and provided it receives the affirmative vote <br />of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and <br />approval by the Mayor. <br /> <br />Adopted: December 16, 1968 <br /> <br />Robert E.
