Graber, Huffman, Kelley, <br /> ~sh~ Wendling <br /> <br /> AN EMERGENCY oRDINANCE providing for the sale of certain <br />real property located at 1471 Belle Avenue, in the City of Lake- <br />wood, Ohio. <br /> <br /> WHEREAS, The said real property (hereinafter described in <br />the body of the agreement) owned by the City of Lakewood, is no <br />longer needed for any municipal purposes, and, <br /> <br /> WHEREAS, It is in the best interest of the City of Lakewood <br />that the said real property be sold, and, <br /> <br /> WHEREAS, The Board of Control of the City of Lakewood has <br />directed that said real property be sold, and, <br /> <br /> WHEREAS, This ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health, <br />safety and welfare and for the usual daily operation of a muni- <br />cipal department; now, therefore, <br /> <br /> BE IT ORDAINED HY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That it is hereby determined that the real <br />property described in the agreement set forth herein is no longer <br />needed for municipal purposes. <br /> <br /> Section 2. This Council hereby authorizes the sale of said <br />land to Robert P. Curry, Sr., and Anna F. Curry, husband and wife, <br />and the Mayor is authorized and directed to execute, on behalf of <br />the City of Lakewood, a contract for the sale of said property, in <br />substantially the following form: <br /> <br />AGREEMENT <br /> <br />THIS AGREEMENT made and concluded at Lakewood, Ohio, .this <br />day of . _0 196 , by and between the City of Lakew0od, <br />whose mailing address is 12650 Detroit Avenue, Lakewood, Ohio, <br />hereinafter called the "VENDOR" and Robert P. Curry, Sr., and <br />Anna F. Curry, husband and wife, hereinafter called .the "VENDEES". <br /> <br />WITNESSETH: <br /> <br />That in consideration of the mutual promises of the parties <br />herein contained, the VENDOR agrees to sell and convey and the <br />VENDEES agree to purchase and pay for, upon and under the pro- <br />visions, terms and conditions herein expressed, the following <br />described premises situated in the City of Lakewood, County of <br />Cuyahoga and State of Ohio: <br /> <br />And being known as SubLot No. 120 in the Belle Avenue <br />Allotment of part of Original Rockport Township Section <br />No. 22 as shown by the recorded plat in Volume 41 of <br />Maps,Page 23 of Cuyahoga County Records, and being 45 feet <br />front on the Easterly side of Belle Avenue, 187.52 feet <br />deep on the Southerly line, 187.62 feet deep on the Northerly <br />line and 45 feet in the rear, as appears by said plat, be <br />the same more or less, but subject to all legal highways~ <br /> <br />and further known as 1471 Belle Avenue, together with all <br />buildings and appurtenances thereon and appurtenant~.thereto <br />or thereon in their present condition... <br /> <br /> <br />
