ORDINANCE NO . 4-69 <br /> <br />Gaydos, Graber, Huffman, <br />Kelley, Usher, Ward <br /> <br /> AN EMERGENCY ORDINANCE to appropriate property at and <br />known as being 1383 Gladys Avenue, Lakewood, Ohio. <br /> <br /> WHEREAS, On the 6th day of January, 1969, the Council <br />of the City of Lakewood, Ohio, adopted Resolution No. 4682, <br />declaring the necessity and intention of appropriating the land <br />hereinafter described, notice of the adoption of which resolu- <br />tion has been served on the owners, persons in possession or <br />having an interest of record in said land, and, <br /> <br /> WHEREAS~ This ordinance constitutes an emergency measure <br />providing for the usual daily operation of a municipal department; <br />now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the fee simple interest in and to the <br />following described real estate be and the same is hereby <br />appropriated for the purpose of construction of off-street <br />parking facilities for the City of Lakewood, Ohio: <br /> <br />Situated in the City of Lakewood, County of Cuyahoga <br />and State of Ohio, and known as being part of Original <br />Rockport Township Section No. 22, and bounded and <br />described as follows: <br /> <br />Beginning in the Easterly line of Gladys Avenue, at the <br />Southwesterly corner of a parcel of land conveyed to <br />Mary E. Wolf~ by deed recorded in Volume 2137, Page 624 <br />of Cuyahoga County Records; thence Easterly along the <br />Southerly line of land so conveyed to Mary E. Wolf, about <br />100.24 feet to the Westerly line of Sub Lot No. 59 in <br />Charles A. Cook's Allotment of part of Original Rockport <br />Township Section NOo 22, as shown by the recorded plat <br />in Volume 25 of Maps, Page 2 of Cuyahoga County Records; <br />thence Southerly along the Westerly line of said Sub <br />Lot No. 59 and the Westerly line of Sub Lot. No. 58 in <br />said allotmento 63-68/100 feet to a point; thence Westerly <br />about 100-34/100 feet to a point on the Easterly line of <br />said Gladys Avenue, which is distant Southerly measured <br />along the Easterly line of said Gladys Avenue 62-12/100 feet <br />from the place of beginning; thence Northerly along the <br />Easterly line of said Gladys Avenue, 62-12/100 feet to <br />the place of beginning and further known as Sub Lot No. 3 <br />and the Southerly 10 feet of Sub Lot No. 4 in Wigmore <br />and Stuart's proposed Subdivision° be the same more or less~ <br />but subject to all legal highways. <br /> <br /> Section 2. That the Director of Law be and he hereby is <br />authorized and directed to apply to a court of competent juris- <br />diction to have a jury impanelled to make inquiry into and <br />assess the corapensation to be paid for the fee simple interest <br />in said property. <br /> <br />Section 3.
