ORDINANCE NO. 38-69 <br /> <br />BY: Messrs. Gaydos, Graber, <br /> Huffman, Usher, Ward <br /> <br /> AN EMERGENCY ORDINANCE giving the consent of the <br />City of Lakewood to Cuyahoga County for the improvement of <br />West ll7th Street (Highland Avenue) by replacing all flexible <br />macadam pavement and defective concrete' pavement with new <br />nine inch (9") concrete pavement. <br /> <br /> WHEREAS, The Board of County commissioners has <br />tentatively agreed to improve West ll7th Street, a County Road, <br />between Lake Avenue and Madison Avenue by removing all flexible <br />macadam pavement and defective concrete pavement and replacing <br />same with new nine inch (9") concrete pavement; and, <br /> <br /> W-HERBS, West ll7th Street is a City Street and <br />also a County Road~ and, <br /> <br /> WHEREAS, This ordinance constitutes an emergency <br />measure providing for the usual daily operation of municipal <br />departments and for the immediate ureservation of the public health, <br />safety and welfare; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That it is declared to be of public <br />interest that the consent of the City be and such consent is <br />hereby given to the improvement of the above-mentioned pavement. <br /> <br /> Section 2. It is hereby declared that the improve- <br />ment aforesaid is of sufficient public importance to the City <br />and that said City is financially able to contribute twenty-five <br />percent (25%) of the cost of the project . <br /> <br /> Section 3. That the Clerk be and she is hereby <br />directed to furnish to the Board of County Commissioners of <br />Cuyahoga County, Ohio, a certified copy of this ordinance <br />immediately upon the taking effect thereof. <br /> <br /> Section 4. This ordinance is hereby declared to <br />be an emergency ordinance immediately neCessary for the <br />preservation of the public peace, health and safety, such <br />emergency existing by reason of the present condition of said <br />pavement and by reason of the inadequacy of such pavement to handle <br />existing and anticipated vehicular traffic between the points herein- <br />before designated, in consequence whereof great public inconvenience <br />is being suffered and will be suffered and public vehicular traffic <br />endangered and delayed, and for the further reason that it is neces- <br />sary to proceed at once in order to complete .the improvement of said <br />pavement during the coming year; and provided it receives the <br />affirmative vote of two-thirds of all members elected to Council, it <br />shall be in force immediately upon its adoption and approval by the <br /> <br />Approved: May 5, 1969 _ ~- <br /> Vic~/~r~es ide~ -/ <br /> <br /> Clerk/. / <br /> Mayor ~' <br /> <br /> <br />
