ORDINANCE NO. 65-69 <br /> <br />BY: Messrs. Ward, Wend. lng, Gaydos, Graber, <br /> Huffman, Kelley, Usher <br /> <br /> AN EMERGENCY ORDINANCE to supplement the Administrative <br />Code of the Codified Ordinances of the City of Lakewood by <br />enacting new Section 137.09, relating to retirement provisions <br />for the members of the Division of Fire. <br /> <br /> WHEREAS~ This ordinance constitutes an emergency <br />measure providing for the immediate preservation of the public <br />health, safety and welfare and for the usual daily operation of <br />a municipal department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OP TitE CITY OF LA~KEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Administrative Code of the Codified <br />Ordinances of the City of Lakewood be and the same is hereby <br />supplemented by enacting new Section 137.09, to read as follows: <br /> <br />Section 137.09 Retirement Provisions; Election <br /> <br />A member of the Division of Fire may, at the time <br />of his retirement, elect to receive all terminal <br />leave benefits including accrued overtime, unused <br />vacation leave, unused holiday leave, accrued <br />longevity, accrued uniform allowance, and any other <br />unused compensatory time, in one lump sum payment. <br />tf the lump sum payment is accepted by said member, <br />he shall be deemed to have terminated his employment <br />at the time of his acceptance. <br /> <br />When a member of the Division of Fire dies, while <br />in paid status, any terminal leave benefits to his <br />credit, as set forth herein, shall be paid in a <br />lump sum to the surviving spouse, if any, and if <br />there is no surviving'spouse, then to the estate of <br />the deceased. <br /> <br />Nothing herein shall be construed to supercede or <br />control policies and procedures of the Police and <br />Firemen's Disability and Pension Fund, as established <br />and operating pursuant to Chapter 742 of the Ohio <br />Revised Code. <br /> <br /> Section 2. That this. ordinance is hereby declared to <br />be and emergency measure for the reasons stated in the prearmble <br />hereof and provided it receives the affirmative vote of two-thirds <br />of all member~ elected to Council, it shall take effect and be in <br />force immedi~ely upon its adoption and/f~--~-----~ ~appr°val by the Mayor. <br /> <br /> , ~.
