<br /> AN EMERGENCY ORDINANCE providing for the sale of
<br />certain real estate located at 12600 Lake Avenue in the City of
<br />Lakewood.
<br />
<br /> WHEREAS, The real property (hereinafter described in
<br />the body of the Agreement) owned by the City of Lakewood, is no
<br />longer needed for any municipal purpose, and,
<br />
<br /> W!iEREAS~ For the foregoing reason it is in the best
<br />interest of the Cit~ of Lakewood that said real property be sold,
<br />and,
<br />
<br /> WHEREAS, The Board of Control of the City of Lakewoo~
<br />has directed that said real property be sold, and,
<br />
<br /> WHEREAS, This ordinance constitutes an emergency measure
<br />providing for the immediate preservation of the public health,
<br />safety and welfare and for the usual daily operation of a municipal
<br />department; now, therefore,
<br />
<br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD,
<br />STATE OF OHIO:
<br />
<br /> Section 1. It is hereby determined that'the real
<br />property described in the agreement set forth~herein, is no'longer
<br />needed for municipal purposes.
<br />
<br /> Section 2. This Council hereby authorizes the sale of
<br />said land to Winton .Place, Inc., and the Mayor is authoriZed and
<br />directed to execute, on behalf of the City of Lakewood, a contract
<br />for the sale of said property, in s~bstantially the following form:

<br /> AGREEMENT
<br />
<br />THIS AGREEMENT made and concluded at La~ewood, Ohio, this
<br />day of , 1969, by and between the City of
<br />Lakewood, whose mailing address is 12650 Detroit Avenue, Lakewoo~,
<br />Ohio, hereinafter called the "VENDOR" and Winton Place, Inc., an
<br />Ohio Corporation, whose mailing address is 1190 Union Commerce
<br />Building, Cleveland, Ohio, hereinafter called the "VENDEE":
<br />
<br />WITNESSETH: ~

<br />That in consideration of the mutual promises of the parties herein
<br />contained, the VE_N-DOR agrees to sell and convey and the VENDEE
<br />agrees to purchase and pay for, upon and under the provisions,
<br />terms and conditions herein expressed, the following described
<br />premises:

<br />PARCEL NO. 1:
<br />
<br />Situated in the City of Lakewood, County of Cuyahoga and State
<br />of Ohio, and known as being part of Original Rockport Township
<br />Section NOo 21, and bounded and described as follows:
<br />
<br />Beginning on the center line of Lake Avenue, 100 feet wide, at
<br />a point which is distant South 73 degrees 41' East, 1054 57/100
<br />feet; measured along said center line from its intersection with the
<br />center line of Nicholson Avenue, said place of beginning being
<br />also the Southeasterly corner of land conveyed to Elva L. Reed, by
<br />deed dated July 1, 1903, and recorded in Volume 887, Page 606 of
<br />Cuyahoga County Records; thence North 00 degrees 50' West along
<br />the Easterly line of land so conveyed to Elva L. Reed, 52 33/100
<br />feet to the Northeasterly line of Lake Avenue, and the principal
<br />place of beginning of the premises herein described; thence South
<br />
