ORDINANCE NO. 4-70 BY: <br /> <br />Messrs. Ward, Wendling, Gaydo~ <br />Graber, Huffman, Kelley, Ushel <br /> <br />AN EMERGENCY ORDINANCE fixing the compensation of the Clerk, <br />directing the time and method of payment of the other employees <br />of the Lakewood Municipal Court and repealing Ordinance NO. 10-69 <br />adopted February 17, 1969. <br /> <br />WI~P~AS, The Municipal Court Act, Revised Code Sections 1901.1 <br />to 1901.38, inclusive, effective October 1, 1953, fixed the <br />compensation of the Judge, provided 'that the compensation of <br />the Bailiff and Deputy Bailiffs shall be as prescribed by the <br />Court, and that the compensation of the Deputy Clerks shall be <br />prescribed by the Clerk, and, <br /> <br />WHEREAS, Said Act further provides that the compensation of the <br />Judge, Clerk and Bailiff shall be paid three-fifths from the <br />City Treasury and two-fifths from the Treasury of the County in <br />which the city is located, and, <br /> <br />WHEREAS, This ordinance constitutes an emergency measure pro- <br />viding for the usual daily operation of a municipal department <br />in that in the interest of public service, welfare and safety, <br />it is necessary to fix the compensation of the Clerk and direct <br />the time and method of payment of the other employees of the <br />Lakewood Municipal Court; now, therefore,. <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF OHIO: <br /> <br />Section 1. That the compensation of the Clerk of the Lakewood <br />Municipal Court is hereby fixed at$13~375 per annum oommencin~ <br />February 8~ 1970. <br /> <br /> Section 2. That the Director of Finance of the City of Lakewood <br />is hereby authorized and directed to pay three-fifths of the <br />compensation of the Judge, three-fifths of the compensation of . <br />the Clerk as herein fixed, three-fifths of the compensation of <br />the Bailiff and all compensation of the Deputy Bailiffs as shall <br />be prescribed by the Judge, all compensation of the Deputy Clerks <br />as shall be prescribed by the Clerk, from the City Treasury in <br />semi-monthly installments or in equal installments every two weeks. <br /> <br />Section 3. This ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided <br />it receives the affirmative vote of two-thirds of all members <br />elected to Council, it shall take effect and be in force immediately <br />upon its adoption and approval by the Mayor and Ordinance 10-69 <br />adopted February 17, 1969 and all other ordinances or parts of <br />ordinances inconsistent herewith, shall be and are hereby repealed. <br /> <br />President <br /> <br />Clerk / <br />Mayor <br /> <br /> <br />
