ORDINANCE NO. 15-70 <br /> <br />BY: <br /> <br />Messrs. Kelley, Usher, Ward, <br />Gaydos, Graber, Huffman <br /> <br /> AN EMERGENCY ORDINANCE authorizing settlement of the <br />claim of Clara Monateri, a widow, not remarried, in the total <br />amount of Two Hundred Fifty Dollars ($250.00), arising out of <br />an accident when she fell on a sidewalk at 1440 Belle Avenue, <br />Lakewood, Ohio, on February 15, 1962. <br /> <br /> WHEREAS, This ordinance constitutes an emergency in <br />that it may save the City from further expense and a possible <br />substantial jury verdict rendered against the City and in that it <br />provides for the usual daily operation of a municipal department; <br />now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That Settlement of the claim of Clara <br />Monateri, a widow, not remarried, in the amount of Two Hundred <br />Fifty Dollars' ($250.00) is hereby ordered and authorized, <br />conditioned upon the execution and delivery by Clara Monateri, <br />a widow, not remarried, of a full release in favor of the city <br />of LakeWood, duly approved by the Director of Law. <br /> <br /> Section 2. That the Director of Finance be and he is <br />hereby authorized to pay the sum of Two Hundred Fifty Dollars <br /> ($250.00) to Clara Monateri, a widow, not remarried, upon <br />delivery to the Director of Finance of the foregoing release <br />duly executed and approved; and to charge the same to the general <br />fund - damages paid bY the City. <br /> <br /> Section 3. That this ordinance is hereby declared to <br />be an emergency measure for the reasons stated in the preamble <br />hereof and provided it receives the affirmative vote of two-thirds <br />of all members elected to Council, it shall take effect and be <br />in force immediately upon its adoption an~pproval by the Mayor. <br /> <br />Adopted: ~, <br /> ~' W~¢e Pres id~nt// <br /> <br /> Clerk <br /> <br />Approved: <br /> <br />Mayor <br /> <br /> <br />
