<br /> certain easements from Arthur W. Steudel and Frieda M. Steudel for the construc-.
<br /> tion of a storp~ sewer together with any connections necess~ry thereto.
<br />
<br /> Whereas, the Grantors are the owner of residential property consisting
<br /> of a house and lot and an adjoining vacant lot t0 the East thereof, and situated
<br />.at 15302 Edgewater Drive, in the County of Cuyahoga, in the State of Ohio;
<br />
<br /> WHER~S, Grantee desires to construct and maintain a storm water sewer,
<br /> or drain, through a portion of the Grantors' said vacant lot and to connect the
<br /> same with an existing public atom water sewer running along the front of the
<br /> residence of the Grantors, which gaid sewer i~ to be used by or for the benefit
<br /> of residents of the City of Lakewood; and
<br />
<br /> WHEREAS, This ordinance constitutes an emergency in that this Council
<br />deems it necessary to proceed as quickly as possible with the construction and
<br />that it provides for the immediate preservation of'the public health, safety
<br />and property, and the usual daily operation of a municipal department, now,
<br />therefore,
<br />
<br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO:
<br />
<br /> Section 1. That for and in consideration of the sum of one thousand
<br />dollars ($1,000) paid by the City 'of Lakewood, Ohio, the Director of Public
<br />Works be and he is hereby authorized and directed to accept the easements from
<br />Arthur W. Steudel and Frieda M. Steudel in words and figures substantially as
<br />follows:
<br />
<br /> (1) The Grantors hereby gmant to the Grantee and to its successors
<br />and assigns, upon the temns and conditions hereinafter set forth, the right,
<br />license and.privilege to construct and maintain an underground storm water sewer
<br />or drain, along an area five (5) feet in width through and under the following
<br />described strip or parcel of land situated in the City .of Lakewood, Cuyahoga
<br />County, Ohio, and being more particularly bounded and described as follows:
<br />
<br /> Situated in the City Of Lakewood, County of Cuyahoga, State of Ohio
<br /> and known as being parts of sublots Number 86, 87, and 88 in the
<br /> Sylvanhurst Subdivision as shown by the recorded plat .in Volume 51
<br /> of Maps, Page 36 of Cuyahoga County Records, and known as' being part
<br /> of Original Rockport Township Section Number 22, and together bounded
<br /> and described as follows:
<br />
<br /> Beginning at the Southeasterly corner of Sublot No. '88 in the Sylvan-
<br /> burst Subdivision as shown by the recorded plat in Volume 51 of. Maps,
<br /> Page 36 of Cuyahoga County Records, thence Westerly along the Southerly
<br /> line of Edgewater Drive (50 feet wide) a distance of about 8.0 feet
<br /> which is the centerline and the principal place of beginning of the
<br /> 5.0 foot sewer easement, thence Northerly and parallel with the
<br /> Easterly line of Sublot No. 88 in said Subdivision, a distance of
<br /> about 230.00 feet or to the Lake banks.
<br />
<br /> And in addition thereto, the Grantor hereby grants to the Grantee a
<br /> 12-foot construction area parallel and adjacent to the West side of
<br /> the proposed easement ' ~.~
<br />
<br />(2) The Grantee agrees that plans for said sewer, or drain, and all connections,
<br />will be submitted to the Grantors for examination and approval before the con-
<br />struction of the same is cormnenced. It is further .agreed by the Grantee that
<br />it will construct and maintain said sewer, or drain, and all connections~ at
<br />all times, without any cost or expense whatever to the Gr-antors, and in such
<br />manner that the same will not damage any property of 'the Grantors, or any
<br />buildings or appurtenances erected or to be erected thereon, or obstruct or
<br />affect access to or from any of the Grantors' property. The Grantee will lay
<br />a 42-inch drain pipc~ from the storm sewer in front of the above residence across
<br />the right-of-way granted herein to the lake at the rear of' the property. The
