ORDINANCE NO. 4-71

<br /> AN EMERGENCY ORDINANCE to provide for written notice of
<br />withdrawal from the Agreement for Central Collection of Municipal
<br />Income Tax between the City o'f Lakewood and the City of Cleveland
<br />and other municipalities, effective December 31, 1971.
<br />
<br /> WHEREAS, on or about July 1, 1967 the City of Lakewood
<br />entered into an agreement with the City of Cleveland and other mun-
<br />icipalities whereby the City of Cleveland, Division of Taxation,
<br />functions as a Central Collection Agency for municipal income taxes
<br />levied by the participants to the Agreement, and
<br />
<br /> W!iEREAS, Article Il{,
<br />provides, in part, as follows:
<br />
<br />Paragraph A of such Agreement
<br />
<br />"Any Participant may withdraw from this Agreement
<br /> for the operation of a Central Collection Agency
<br /> provided, however, that any such withdrawal shall
<br /> be effective only on December 31 of any given year
<br /> and shall be preceded by written notice of with-
<br /> drawal via registered mail and return receipt, re-
<br /> ceived by the Agency Administrator no later than
<br /> February 20 prior to the effective date of such
<br /> withdrawal," and
<br />
<br /> WHEREAS, due to the announced intention of the City of
<br />Cleveland to cancel tax reciprocity, the City of Lakewood, must,
<br />in the future, amend its income tax ordinance with respect to
<br />reciprocity and, therefore, it is necessary to withdraw from the
<br />Agreement for Central Collection facilities, and
<br />
<br /> WHEREAS, the failure to amend the City's municipal in-
<br />come tax ordinance with respect to reciprocity will result in a
<br />shortage of funds necessary to continue the normal operation of
<br />the City, and
<br />
<br /> WHEREAS, this ordinance constitutes an emergency measure
<br />providing for the immediate preservation of the public health,
<br />safety and welfare and for the usual daily operation of a municipal
<br />department, now, therefore,
<br />
<br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD,
<br />STATE OF OHIO:
<br />
<br /> "'Section 1. It is hereby determined that the City of
<br />Lakewood shall withdraw from the Agreement for Central Collection
<br />of Municipal Income Tax between the City of Lakewood and the City
<br />of Cleveland and other municipalities, effective December 31, 1971.
<br />
<br /> Section 2. The tax Administrator is hereby authorized
<br />and directed to give notice of such withdrawal on behalf of the
<br />City of Lakcwood in writing together with a certified copy of this
<br />ordinance to Mr. Louis V. Corsi, Administrator of the Central Col-
<br />lection Agency, 1701 Lakes[de Avenue N.E., Cleveland, Ohio
<br />by registered mail, return receipt requested, so as to be receJ, vcd
<br />by him no later than February 20, ]971.
