ORDINANCE NO. 5-71 BY: Messrs. Ward, Wendling, Gaydos, Graber, Huffman, Kelley, Usher AN EMERGENCY ORDINANCE authorizing settlement of the claim of Irene T. Cesen, divorced, in the total amount of ?~o Hundred and Fifty Dollars ($250.00), arising out of a motor vehicle accident involving a City of Lakewood police vehicle on Madison Avenue near the intersection of Grace Avenue, Lake- wood, Ohio on June 4, 1964. WHEREAS, this ordinance constitutes an emergency in that it will save the City further legal expense and a possible substantial jury verdict rendered against the City and/or one of its police officers, and in that it provides for the usual daily operation of a municipal department, now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That settlement of the claim of Irene T. Cesen, divorced, in the amount of Two Hundred Fifty Dollars ($250.00) is hereby ordered and authorized, conditioned upon the execution and delivery by Irene T. Cesen, divorced, of a full release in favor of the City of Lakewood and Leonard J. Klucar, a Lakewood Police officer, duly approved by the Director of Law. Section 2o That the Director of Finance be and he is hereby authorized to pay the sum of Two Hundred Fifty Dollars ($250.00) to Irene T. Cesen, divorced, upon delivery to the Director of Finance of the foregoing release duly executed and approved .and to charge the same to the general fund - damaqes paid by the City. Section 3. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof, and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
