ORDINANCE NO. 16- 71 BY: Messrs. Usher, Ward, Gaydos, Graber, Huffman AN ~,LERG~ICY ORDIi,IA~ICE to levy special assessments for the im- provement of Belle Avenue in the City of L~ewood, Ohio, between certain termini by the necessary grading of the base, resurfacing with asphalti~ concrete including the necessary replacement and resetting of castin~.s and the necessa~! rese=ting and replacing .of curbs to~ether with the-necessary appurtenances thereto. WPIERF~, this Council by two-thirdszvote of the members elected thereto determines tha~ this ordinance is an emergency measure which is necessary for ~he L~uediate preservamion of the public peace, property, health and safe~y ~d for the further reason that the assessmen=s herein provided for mus~ be promptly levied in order to retire outstanding no~es by the issuance ef bonds and thereby preserve .the credit of the City. NOW, TH~P~0RE, BE IT ORDA~iED by the Council of the City of Lakewood, Cuyahoga County, State of Ohio: Section 1. That the assessment of the cost and expense of improving Belle Avenue from Detroit Avenue ~o Clifton Boulevard in. the City of Lakewood, Ohio, by the necessary grading of ~hebase, resurfacing with asphaltic concrete including ~he necess~r~y replacement and resetting of castings and the necessary rese~ting and replacing of.curbs ~ogether w~th the necessm_~ appurtenances thereto as se~ forth in Resolution I~o. 4756 adooted by this Council on February 16, 1970 and amounting in the aggregate to $15,25B.52 as reported to this Council on the 15th day of March, 1971, by the Director of Finance, be ~ud Zhe s~me is hereby'adopted and confirmed, and that there be and are hereby levied and assessed uoon the lots and lands bounding and abutting upon said i~provemen~ the several muounts reported as aforesaid, which assessments and the description of said lots and lands are now on file in the office of the Clerk of Council and which assessments are in propo~ion to the special benefits, and are not in excess of any statutory limitation. Section 2. That ~the total assessment against each lot or parcel of land shall be payable in cash not later than May 15, 1971, or at the option of the o~mer, in five annual installments with interest at the same rate as shall be borne by the bonds to be issued in anticipation of the collection of the same. AT1 cash payments shall be made to the Director of Finance of said City. Ail assessments and instailmen~s thereof remaining unpaid a~ the expiration of said period shall be certified by the~Director of Finance to the County Auditor as provided by law ~o be placed by him on the tax duplicate and collected as other taxes are collected. Section B. This ordinance, having been determined to be an emergency measure, shall be in full force and effect from and immediately after its passage and approval by the Mayor.
