Huffman, Usher, <br /> Ward, Gaydos, Graber <br /> <br /> AN ~4ERGEI~CY ORDINANCE to levy spec/al assessments for the im- <br /> provement of Ethel Avenue in the'City of Lakewcod, Ohio, between certsin <br /> termini by the necessaz-/ grading of .the base, resurfacing with asphaltic <br /> concrete including the necessary replacement and resetting of castings <br /> and the necessa~! resetting and replacing of curbs together with the necessar-y <br /> appurtenances thereto. <br /> <br /> WHEREAS, this Council t~y two-thirds vote of the members elected <br />thereto determines that this ordinance is s.u emergency measure which is <br />necessary for the ir~ediate preservation of the oubl/c peace, property, <br />health and safety and fOr the further reason that the assessments herein <br />provided for must be promptly levied in order to re~ire outstanding notes <br />by the issuance of bonds and thereby preserve the credit of the City. <br /> <br /> NOW, THEREFORE, BE IT 0RDAIHED by the Council of the City of <br />Lakewood, Cuyahoga County, State of Ohio: <br /> <br /> Section 1. That the assessmen~ of the cost and expense of imoroving <br />Ethel Avenue from Detroit Avenue to Clifton Boulevard in the City of La~ewood, <br />Ohio, by the necessary grading of the base, resurfacing with asphaltic <br />concrete including the necessary replacement and resetting of castings <br />and the necessar-y resetting and reolacing of curbs together with the necessary <br />appurtenances there~o as se~ forth-in Resolution No. 4758 adopted by this <br />Council on February 16, 1970 ~ud amounting in the aggregate ~o $8,268.23 <br />as reported to this Council on the 15th day of March, lg?l, by the Director <br />of Finance, be and the s~me is hereby adopted and confirmed, and that <br />there be and are hereby levied and assessed upon the lots and lands bounding <br />and abutting upon said improvement the several amounts reoor~ed as aforesaid, <br />which assessments and the description of said lots and l~ds are now on <br />file in the office of the Clerk of Council and which assessments ~re in <br />proportion to the special benefits, and are not in excess of any statutory <br />limitation. <br /> <br />Passed: March 15, 1971 <br /> <br /> Section 2. That the total assessmenn against each lot or parcel <br /> of land shall be nayable in cash not la~er than .u <br /> - ,~ay 15, 1971, or at the <br />option of the owner, in five a~mual installments with interest at the <br />same rate as shall be borne by the bonds to be issued in anticipation <br />of 'the collection of the same. All cash pa)~nents shall be made to the <br />Director of Finance of said City. All assessments and installments thereof <br />remaining unpaid at the exniration of said oeriod shall be certified by <br />the Director of Finance to-the County AuditOr as. nrovided by law to be <br />placed by him on the tax duplicate and collected as other taxes are collected. <br /> <br /> Section 3.
