Gaydos, Graber, Huffman, Usher, Ward AN ~LERG~NCY ORDIi;AECE to levy speci-1 assessments for the im- provement of Hals~ead Stree~ in the City of Lakewood, Ohio, between certain termini by the necessar~3 grading of the .base, ~esurfacing with asph~itic concrete including the necessary replacement 84~d resetting of castings ~nd the necess~-~' resegting and replacing of curbs together with the necessary appurtenances thereto. WHEREAS, this Council by two-thirds vote of the members elected thereto determines that this ordinance is an emergency measure which is necessary for the ir~edia~e preservation of the public peace, property, health and safety and for the further reason that the assessments herein provided for mus~ be oromptly levied in order ~o retire outstanding no~es by the issuance of bo~ds and thereby preserve the credit of the City. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Lakewood, Cuy~hoga County, State of Ohio: Section 1. That the assessment of the cost and expense of improving Halstead Street from Madison Avenue ~o Plover Street in the City of Lakewood, Ohio, by the necessmry grading of the base, resurfacing with asphaltic concrete including ~he necessary replacement and resetting of castings and the necessary resez%ing and replacing of curbs together with the necessary appurtenances =hereto as set forth in Eesolution No. k760 as ar. ended by ~768 adopted by ~his Council on February 16, 1970 ~nd April 6, 1970, respectively, and amounting in the aggregate to $6,212.52 as reported ~o ~his Council on the 15th day of March, 1971, by Zhe Director of Finance, be and the same is hereby adopted and confirmed, smd that ~here be and are hereby levied and assessed upon %he lots and lands bounding and abutting upon said imorovemen~ ~he several amounts reported as aforesaid, which assessments and the-descriotion of said lo~s and lands are now on file in the office of the Clerk o~ Council and which assessments are in proportion to the special benefits, and are not in excess of any statutory limitation. Section 2. That the to~al assessment against each lot or parcel of land shadl be payable in cash not la~er than May 15, 1971, or at the option of the owner, in five annual ins=aliments with interest at the same rate as shall be borne by the bonds to be issued in anticipation of the collection of the smme. All cash payments shall be made to the Director of Finance of said City. All assessments and installments ~hereof remaining unpaid at the expiration of said period shall be certified by the Director of Finance to ~he County Auditor as provided by law to be placed by him on the tax duplicate and collected as other ~axes are collected. Section 3.
