WHEREAS, this Council by two-thirds vote of the m~mber~.e~e~ted thereto determines =ha~ this ordinance is an emergency measure wnzcn zs mecessary for ~he i~ediate =reservation of ~he =ublic =cate, proper+~Y, health and safe~y ~ud for the further reason =ha~ ~he assessments herein provided for mus= be pro=p~ly levied in order ~c retire ou~s=~uding notes by the issuance of bonds and thereby preserve the credit of the City. NOW, TH~P£FORE, BE IT ORDAIH~by the Council of the City of Lakewood, Cuyahoga County, Sta~e of Ohio: Section 1. That the assessment of the cost ~ud ex=ense of improving Robinwood Avenue from De~roit Avenue to Madison Avenue in the City of Lakewood, Ohio, by the necessary grading of the base, resurfacing wi~h asphaltic concrete including the necessa~Y replacement and rese~ing of castings and the necessary rese~in~ an~ replaein~ o~ curbs ~ ~-~ 7 ~[ith the necessary appurtenances ~here~o as se~ forth in Resolution ~o. adopted by this Co~cil on February 16~ !~70 and amo~tin~ in the m~re~ate to $10,945~77 as re~orted to ~his Codicil on the tSth ~my o£ March~ ~the Director of ~inance, be ~ud ~he sa~e is hereby adopted ~d eon£irmed, -an~ that there be ~d ~e hereby levied ~ assessed u~on the lots an~ lands bo~uding an~ ~utting upon said improvement the sever~i amounts reported as ~fores~i~, ~hich assessments an~ the description of said lots au~ lands are now on file in the Office of the Clerk of Council ~nd ~hich assessments are in proportion to the sneci~4 benefits, and are not in excess of any st~$u~ory 1Lmitation. Section 2. That the total assessment a~ainst each lot or ~arcel of lan~ shall be payable in cash not later than M~y 15, 1971, or ~ the option of the o~rner, in five ~unu~l installments with interest mt the same r~te as shall be borne by the bonds to be issued in anticination of the collection o~ ~he s~me. All c~sh payments sh~!l be mmde ~o the Director of Finance of said City. Ail assessments ~d ins~m!!ments thereof re~aininG unpaid at the expiration of said neriod shall be certified by the Director of Fine, ce to the County Auditor ~s nrovided by tmw to be nl~ced by hi~ om the tax duplicate and collec~ed as other t~zes are collected.
