ORDINANCE NO. 27-71 <br /> <br />BY: <br /> <br />Messrs. Huffman, Kelley, Usher, <br />Ward, Wendling, Gaydos, Graber <br /> <br /> AN EMERGENCY ORDINANCE to amend'Section 545.03 of the <br />General Offenses Code of the Codified Ordinances of the City of <br />Lakewood .relating to removal and disposition of junk vehicles to <br />provide for the charging of a storage fee for ~uch impounded <br />vehicles. <br /> <br /> WHEREAS, a substantial portion of the municipal parking <br />lot located at 12650 Detroit Avenue is being occupied by impounded <br />junk vehicles, and <br /> <br /> WHEREAS, the City should be compensated for the use of <br />said space, and <br /> <br /> WHEREAS, the charging of a storage fee for impounded junk <br />vehicles would serve as an inducement to the removal of said vehicles, <br />and <br /> <br /> WHEREAS,this ordinance constitutes an emergency measure <br />providing for the usual daily operation of a municipal department, <br />now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: -- <br /> <br /> Section 1. That Section 545.03 of the General Offenses <br />Code of the Codified. Ordinances of the City of Lakewood, now reading <br />as follows: <br /> <br /> 545.03 REMOVAL Ai!D DISPOSITION OF JTJNK VEHICLES. <br /> "Any junk vehicle which is disposed of in violation <br /> of Section 545.02 shall be deemed abandoned at the <br /> end of the twenty-four hour period, and shall be <br /> subject to being impounded, removed and conveyed <br /> by towing or Other means, by order of any member <br /> of the Division of Police to any area (public or <br /> private) where it may be lawfully placed° After <br /> being impounded for a'minimum of ten days, such <br /> junk vehicle may be sold'for salvage value or other- <br /> wise permanently disposed Of'o"'.. <br /> <br />be and the same is hereby amended to read as follows: <br /> <br /> 545.03 REMOVAL AND DISPOSITION OF JUNK VEHICLES'; STORAGE CHAR( <br />"Any junk vehicle found in violation of Section 545.02 <br /> shall be deemed abandoned and shall be subject to being <br /> impounded, removed and conveyed by towing or other means, <br /> by order of any member of the Division of Police to any <br /> area (public or private) where it may be lawfully placed. <br /> After being impounded for a minimum of ten days, such <br /> junk vehicle may be sold for salvage value or otherwise <br /> permanently disposed of. <br /> <br />The owner of a junk vehicle impounded ten or more days <br />on public property shall be charged a storage fee of Two <br />Dollars ($2.00) per day or any part thereof commencing the <br />first day of such impounding." <br /> <br /> <br />
