ORDINANCE NO. 33-71 BY: Messrs. Wendling, Gaydos, Graber, Huffman, Kelley, Usher, Ward AN EMERGENCY ORDINANCE authorizing settlement of the claim of Willis C. Todd, married, in the total amount of Four Thousand Seven Hundred and Fifty Dollars ($4,750.00) arising out of an accident which occurred on February 23, 1964 on which date Mr. Todd was caused to slip and fall on a substantial icy section of sidewalk in front of 12997 Clifton Blvd., Lakewood, Ohio. W~EREAS, This ordinance constitutes an emergency in that it will save the City further legal expense and a possible substantial jury verdict rendered against the City and in that it provides for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That settlement of the claim of Willis C. Todd, married, in the amount of Four Thousand Seven Hundred and Fifty Dollars ($4,750.00) is hereby ordered and authorized, cond- itioned upon the execution and delivery by Willis C. Todd, married, of a full release in favor of the City o~ Lakewood, duly approved by the Director of Law. Section 2. That the Director of Finance be and he is hereby authorized to pay the sum of Four Thousand Seven Hundred and Fifty Dollars ($4,750.00) to Willis C. Todd, married, upon delivery to the Director of Finance of the foregoing release duly executed and approved; and to charge the same to the general fund - damages paid by the City. Section 3. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to' Council, it shall take effect and be in force im- mediately upon its adoption and approval by the.Mayor.
