ORDINANCE NO. 49-71 <br /> <br />BY: <br /> <br />Messrs. Gaydos, Graber, Huffman, <br />Kelley, Usher, Ward, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor on behalf <br />of the City of Lakewood to enter into an agreement with the Kiwanis Club of Lake- <br />wood, Ohio, Incorporated, a nqn-profit community service corporation, for the <br />sharing of the cost of construction of a picnic pavilion in Lakewood Park and <br />authorizing the Director of Public Works to proceed with said construction. <br /> <br /> REAS, The City is desirous of cons~ucting a picnic pavilion in <br />Lakewood Park for the use and enjoyment of the residents of the City and others, <br />and <br /> <br /> WHEREAS, The Kiwanis Club of Lakewood, Ohio, Incorporated is willing <br />and desirous of cooperating jointly with the City in the construction of such <br />picnic pavilion, including payment of part of the costs thereof, and <br /> <br /> WHEREAS, Both the City and the Kiwanis Club of Lakewood, Ohio, Incor- <br />porated have approved the design of such picnic pavilion, the construction cost <br />of which is approximately Thirty Thousand Dollars ($30,000.00), and are desirous <br />of proceeding with the construction of same, and <br /> <br /> WHEREAS, This ordinance constitutes an emergency measure providing for <br />the usual daily operation of a municipal department, now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL oF THE CIT~ OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be-and he is ~ereby authorized~ and directed <br />on behalf of the City of Lakewood to enter into an agreement with the Kiwanis <br />Club of Lakewood, Ohio, Incorporated, which agreement shall be substantially as <br />set forth in Exhibit A attached hereto and made a part hereof. <br /> <br /> Section 2. That the Director of Public Works i~ hereby authorized and <br />directed to proceed with the construction of said picnic pavilion at such time as <br />the aforementioned agreement is duly executed by' both parties..thereto. <br /> <br /> Section 3. The cost of construction of the said picnic pavilion shall <br />be paid from the Miscellaneous Improvement Fund, said total cost not to exceed $30,000. <br /> <br /> Section 4. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof, and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by th~ <br />Mayor. <br /> <br />Adopted: <br /> <br />Approved: <br /> <br /> Presiden~ <br /> <br />Clerk <br /> <br />Mayor <br /> <br /> <br />
