ORDINANCE NO. 13-72 BY: Messrs. McBride, Usher, Wendling, <br /> Brockman, Graber, Kelley, Magnott <br /> <br />AN E~RGENCY ORDINANCE fixing the compensation of the Clerk, directing <br />the time and method of payment of the other employees of the Lakewood <br />Municipal Court and repealing Ordinance No. 9-71 adopted February 15, 1971. <br /> <br />WHEREAS, The Municipal Court Act, Revised Code Sections 1901.1 to 1901.38, <br />inclusive, effective October 1, 1953, fixed the compensation of'the Judge, <br />provided that the compensation of the Bailiff and Deputy Bailiffs shall <br />be as prescribed by the Court, and that the compensation of the Deputy <br />Clerks shall be prescribed by the Clerk, and, <br /> <br />WHEREAS, Said Act further provides that the compensation of the Judge, <br />Clerk and Bailiff shall be paid three-fifths from the City Treasury and <br />two-fifths from the Treasury of the County in which the city is located, <br />and, <br /> <br />WHEREAS, This ordinance constitutes an emergency measure providing for the <br />usual daily operation of a municipal department in that in the interest of <br />public service, welfare and safety, it is necessary to fix the compensation <br />of the Clerk and direct the time and method of payment of the other employees <br />of the Lakewood Muncipal Court; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That the compensation of the Clerk of the Lakewood Municipal <br />Court is hereby fixed at $14,957 per annum commencing February 6, 1972. <br /> <br />Section 2. That the Director of Finance of the City of Lakewood is hereby <br />authorized and directed to pay three-fifths of the compensation of the <br />Judge, three-fifths of the compensation of the Clerk as herein fixed, three- <br />fifths of the compensation of the Bailiff and all compensation of the Deputy <br />Bailiffs as shall be prescribed by the Judge, all compensation of the D;~puty <br />Clerks as shall be prescribed by the Clerk, from the City Treasury in semi- <br />monthly installments or in equal installments every two weeks. <br /> <br />Section 3. This ordinance is hereby declared to be an emergency measure <br />for the reasons stated in the preamble hereof and provided it receives the <br />affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption mhd approval <br />by the Mayor and Ordinance No. 9-71 adopted February 15, 1971 and all <br />other ordinances or parts of ordinances inconsistent herewith, shall be and <br />are hereby repealed. <br /> <br />Adopted:' )," <br /> <br /> <br />
