ORDINANCE NO. 36-72 <br /> <br />BY: <br /> <br />Messrs. McBride, Usher, Wendltng, <br />Brockman, Graber, Kelley, Magnotto <br /> <br />AN Eb~RGENCY ORDINANCE to amend Section 1709.36. of the Sanitary <br />Code of the Codified Ordinances of the City of Lakewood relating <br />to housing licenses to provide for licensing of Condominium <br />Property. <br /> <br />WHEREAS, This Council determines that it is essential to preserve <br />the health, safety and welfare of the citizens of Lakewood that a <br />housing'license be required for Condominium Property and, <br />WHEREAS, This ordinance constitutes an emergency measure 5v~¥iding for the <br />immediate preservation of the public health or safety, now, therefore, <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br /> OHIO: <br /> Section 1. That Section 1709.36 of the Sanitary Code of the <br /> Codified Ordinances of the City of Lakewood now reading as follows: <br /> <br />SECTION 1709.36 HOUSING LICENSE <br /> <br />" No person shall let, rent, lease, conduct, operate, <br /> occupy, maintain or own any building or portion of <br /> any building in which more than two dwelling units <br /> are let or in which a rooming house is operated, or <br /> own any interest therein, unless a housing license <br /> as provided in this chapter has been applied for, <br /> issued and is in force." <br /> <br />be and the same is hereby amended as follows: <br /> <br />SECTION 1709.36 HOUSING LICENSE <br /> <br />(a) <br /> <br />No person shall let, ~ent, lease, conduct, operate, <br />occupy, maintain or own any building or portion of <br />any building in which more than two dwelling units <br />a~e let or in which a rooming house is operated, or <br />own any interest therein, unless a housing license <br />as provided in this chapter has been applied for, <br />issued and is in force. <br /> <br />(b) <br /> <br />Condc'ainium property as the same is defined in Chapter <br />5311, <>bio Revised Code, shall be required to obtain a <br />housing license as provided herein, which license shall <br />be obtained by the owner of the Condominium Property or <br />by the Unit Owners Association at such time said associ- <br />iation has been formed. <br /> <br />Section 2.
