OP. DINANCE NO. 41-72 <br /> <br />Messrs. Brockman, Graber, <br />Kelley, Magnotto, McBride, <br />Usher, Wendling <br /> <br /> AN EMERGENCY ORDINANCE to provide for the submission to the electorate <br />of Ordinance No.~ 7-72 adopted March 20, 1972, which ordinance amended and supple- <br />mented Sections 1111.12 and 1135.01 of the Zoning Code of the Codified Ordinances <br />of the City of Lakewood by changing and revising the Zoning Map and the Building <br />Line Map with respect to certain property situated on Detroit Avenue in the City <br />of Lakewood. <br /> <br /> WHEREAS, there have been filed with the Clerk of Council petitions signed <br />by qualified electors equal in number to at least fifteen percent (15%) of the total <br />votes cast for the election of a mayor at the last preceding general municipal <br />election at which a mayor was elected requesting that Ordinance No. 7-72 be repeal- <br />ed or be submitted to a vote of the electors of the City, and <br /> <br /> WMERF~S, upon reconsideration of said ordinance, this Council did not <br />entirely repeal Ordinance No. 7-72, and <br /> <br /> WHEREAS, pursuant to Article XI, Section 6 of the Amended Charter of the <br />City of Lakewood, Council is required to submit said ordinance to a vote of the <br />electors, and <br /> <br /> WHEREAS, no primary,regular municipal or general election is to be held <br />not more than six (6) months or less than thirty (30) days after, the refusal of this <br />Council to repeal said ordinance, now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Ordinance No. 7-72 adopted March 20, 1972 which reads <br />as follows: <br /> <br />"An Ordinance to amend and supplement Section 1111.12 and Section 1135.01 <br /> of the Zoning Code of the Codified Ordinances of the City of Lakewood by <br /> changing and revising the Zoning Map and the Building Line Map with <br /> respect to certain property all as hereinafter set forth and described. <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CII~ OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That Section 1111,12 of the Zoning Code of the Codified <br />Ordinances of the City of Lakewood be and it is hereby amended by <br />changing and revising the Zoning Map to the extent that the property <br />described as follows: .. <br /> <br />Situated in the City of Lakewood, County of Cuyahoga and State of Ohio <br />and known as being part of Original Rockport Township, Section No. 22, <br />being parts of sublots No. 382, 288 and all of sublot No. 381 in the <br />Lakewood Realty Company's Subdivision as shown by the recorded plat in <br />Volume 25 of Maps, Page 26 of Cuyahoga County Records, and. being all of <br />sublot No. 248 in the Lakewood Realty Company's Lakewood Park Sub- <br />division as shown by the recorded plat in Volume 27 of Maps, Page 26 <br />of Cuyahoga County Records, and bounded and described as follows: <br /> <br />Beginning at the northwesterly corner of Sublot No. 248 in the second <br />mentioned subdivision which point is about 206.79 feet north of the <br />northerly line of Detroit Avenue (76 feet wide) originally (66 feet <br />wide) thence easterly a distance of about 260 feet to the westerly line <br />of Belle Avenue (60 feet wide) which point is also the northeasterly <br />corner of sublot No. 381 in said Subdivision, <br /> <br /> <br />
