ORDINANCE NO. 42-72 <br /> <br />BY: Messrs. McBride, Usher, <br /> Brockman, Kelley, Magnotto <br /> <br /> AN EMERGENCY ORDINANCE to amend Section 107.10 of the Administrative <br />Code of the Codified Ordinances of the City of Lakewood providing for the manner <br />of giving notice of proposed Charter amendments. <br /> <br /> WHEREAS, Section 7 of Article XXI of the Amended Charter of the City <br />of Lakewood has been amended to permit newspaper advertising as sufficient notice <br />of proposed Charter amendments, and <br /> <br /> WHEREAS, This ordinance constitutes an emergency measure providing for <br />the immediate preservation of the public welfare and the usual daily operation of <br />a municipal department, now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 107.10 of the Administrative Code of the <br />Codified Ordinances of the City of Lakewood, now reading as follows: <br /> <br />107.10 NOTICE OF PROPOSED CHARTER AMENDMENTS. <br /> <br />Notice of a proposed Charter amendment shall be made as provided <br />in Article XXI Section 7 of the Amended City Charter. <br /> <br />be and the same is hereby amended to read as follows: <br /> <br />107.10 NOTICE OF PROPOSED CHARTER AMENDMENTS. <br /> <br />Notice of proposed Charter amendments shall be given in one of the <br />following ways: <br /> <br />(a) <br /> <br />Not less than thirty days prior to the election ~t which the <br />amendment is to be submitted to the electors, t[~e Clerk of Council <br />shall mail a copy of the proposed charter amendment to each elector <br />whose name appears upon the poll or registration books of the last <br />regular or general municipal election. <br /> <br />The full text of the proposed charter amendment shall be published <br />once a week for not less than two consecutive weeks in a newspaper <br />published in the City, with the ffrst publication being at least <br />fifteen days prior to the election at which the amendment is to <br />be submitted to the electors. If no newspaper is published in <br />the City, then such publication shall be made in a newspaper of <br />general circulation within the City° <br /> <br /> Section 2. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon the adoption and approval by the <br /> <br />Mayor. <br /> <br />Adopted: <br /> <br /> <br />
