ORDINANCE NO. 4-73 <br /> <br />BY.: Messrs. Usher, Wendling, Werner, <br /> Brockman, Graber, Magnotto, McBr <br /> <br /> AN EMERGENCY ORDINANCE to appropriate' property at and known as being <br />1371-73 St. Charles Avenue, Lakewood, Ohio° <br /> <br /> WHEREAS, on the 20th day of November, 1972 the Council of the City of <br />Lakewood adopted ResolUtion Noo 4909, declaring the necessity and intention of <br />appropriating the land hereinafter described, notice of the adoption of which <br />resolution has been Served on the owners, persons in possession or having an <br />interest of record in said land, and, <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br />the usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the.fee simple in add to the following described real <br />estate be and the same is hereby appropriated for the purpose of Construction <br />of a multi-level municipal parking garage facility for the City of Lakewood, Ohio. <br /> <br />Situated in the City of Lakewood, County of Cuyahoga and State <br />of Ohio and known as being Sublot N0o 250 in The Lakewood Realty <br />Company's Lakewood Park Subdivision of part of Original Rockport <br />Township Section No. 22 as shown by the recorded plat in Volume 27 <br />of Maps, Page 26 of Cuyahoga County Records, and being 40 feet front <br />on the Easterly side of Sro Charles Avenue, and extending back of <br />equal width 130 feet, as appears by said plat, be the same more or <br />less, but subject to all legal highways° <br /> <br /> Section 2. That the Director of Law be and he is hereby authorized and <br />directed to apply to a court of competent jurisdiction to have a jury impanelled to <br />make inquiry into and assess the compensation to be paid for the fee simple interest <br />in said property. <br /> <br /> Section 3o That this ordinance is hereby declared to be an emergency <br />measure for the reasons set forth in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br /> <br />Mayor <br /> <br />Adopted: <br /> <br />Clerk <br /> <br />Mayor <br /> <br /> <br />
