ORDINANCE NO. 12-74 BY: Messrs. Chinnock, Graber, Magnotto, McBride, Sinagra, Usher, Brockman AN EMERGENCY ORDINANCE fixing the compensation of the Clerk, directing the time and method of payment of the other employees of the Lakewood Municipal Court and repealing Ordinance No. 13-73 adopted February 1, 1973. WHEREAS, the Municipal Court Act, Revised Code Sections 1901.1 to 1901.38, inclusive, effective October 1, 1953, fixed the compensation of the Judge, provided that the compensation of the Bailiff and Deputy Bailiffs shall be as prescribed by the Court, and that the compensation of the Deputy Clerks shall be prescribed by the Clerk, and, WHEREAS, said Act further provides that the compensation of the Judge, Clerk and Bailiff shall be paid three-fifths from the City Treasury and two-fifths from the Treasury of the County in which the city is located, and, WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department in that in the interest of public service, welfare and safety, it is necessary to fix the compensation of the Clerk and direct the time and method of payment of the other employees of the Lakewood Municipal Court; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1o Thaf the compensation of the Clerk of the Lakewood Municipal Court is hereby fixed at $19,500 per annum commencing February 3, 1974. Section 2. That. the Director of Finance of the City of Lakewood is hereby authorized and directed to pay three-fifths of the compensation of the Judge, three-fifths of the compensation of the Clerk as herein fixed, three- fifths of the compensation of the Bailiff and all compensation of the Deputy Bailiffs as shall be prescribed by the Judge, all compensation of the Deputy Clerks as shall be prescribed by the Clerk, from the City Treasury in semi- monthly installments or in equal installments every two weeks. Section 3. This ordinance is hereby declared to be an emergency measure for the reasons stated in~e preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval. by the Mayor and Ordinance No. 13-73 adopted February 1, 1973 and all other ordinances or parts of ordinances inconsistent herewith, shall be and are hereby repealed.
