ORDINANCE NO. 31-74 <br /> <br />BY: Messrs. Usher, Brockman, Chinnock, Grab <br /> Magnotto, McBride, Sinagra <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor to enter into an <br />agreement accepting a License For Pipe Line Facility from Norfolk and Western <br />Railway Company in connection with the construction of the Hazelwood-Thoreau- <br />Donald sewer project. <br /> <br /> WHEREAS, the Norfolk and Western Railway Company is the owner of <br />certain premises situated in the' City of Lakewood consisting of a railroad <br />right-of-way, and <br /> <br /> WHEREAS, the City of Lakewood desires to construct and maintain a <br />sanitary and storm water sewer along, under and through part of said right-of- <br />way in connection with the construction and maintenance of the Hazelwood-Thoreau- <br />Donald sewer project of the City of Lakewood, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing for <br />the usual daily operation of a municipal department and for the immediate preser- <br />vation of the public health, safety and welfare in that the City determines it <br />necessary to proceed as quickly as possible with the construction of said sewer <br />project to relieve the flooding condition in the area of the proposed sewer <br />project; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That for and in consideration of the sum of Four Thousand <br />Nine Hundred Ten Dollars ($4,910.00) paid by the City of Lakewood, Ohio the <br />Mayor be and he is hereby authorized and directed to enter into and execute <br />an agreement for the License For Pipe Line Facility with with Norfolk and Western <br />Railway Company, a copy of which License Agreement is attached hereto and made a <br />part hereof~ said payment to be paid out of the Sewer Improvement Fund. <br /> <br /> Section 2.
