ORDINANCE NO. 38-74 BY: Messrs. Graber, Magnotto, McBride, <br /> Sinagra, Usher, Brockman, Chinnock <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Director of Public Works to <br />advertise for bids for the sale of two residential properties located at <br />1466 Marlowe Avenue and 1463 Belle Avenue respectively, in the City of Lakewood, <br />which property is now owned by the City of Lakewood and determining that it is <br />in the best interest of the City that said property be sold. <br /> <br /> WHEREAS, the properties located at 1466 Marlowe Avenue and 1463 Belle <br />Avenue were originally purchased by the City to be used by Lakewood ltospital <br />for housing single interns and residents, and <br /> <br /> WHEREAS, these programs have been eliminated at Lakewood Hospital <br />and the aforementioned properties are now only used for minor storage, and <br /> <br /> WUEREAS, this change in circumstances indicates a desirability to sell <br />the aforementioned residential properties which are no longer needed for any <br />municipal purpose, and <br /> <br /> W~[EREAS, this ordinance constitutes an emergency measure in that it <br />provides for the immediate preservation of tile public health, safety and welfare <br />and for the usual daily operation of a municipal department in that said properties <br />should be sold at the earliest possible time; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF TIIE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section i. That this Council determines that the residential properties <br />located at 1466 Marlowe Avenue and 1463 Belle Avenue respectively, in the City of <br />Lakewood, should be sold and that such sale is in the best interest of the City. <br /> <br /> Section 2. That this Co~ncil determines that the sale of the afore- <br />mentioned residential properties will further the interests of this City and its <br />residents. <br /> <br /> Section 3. That the Director of Public Works is hereby authorized to <br />advertise for bids for the sale of the residential properties located at 1466. <br />Marlowe Avenue and 1463 Belle Avenue and further designated as Permanent Parcel <br />No's. 314-7-29 and 314-7-16 respectively. <br /> <br /> Section 4. That said advertisements shall state that any contract for <br />the sale of said properties shall be subject to the approval of Council; that the <br />conveyances will be by the usual form of warranty deed used by the City and shall <br />be subject to taxes and assessments, both general and special, if any, all of <br />which shall be prorated as of the date of filing the deeds for record and subject <br />to restrictions, conditions and reservations of record and zoning ordinances; <br />that the City will furnish the purchaser or purchasers a title guarantee goaranteeing <br />a good and marketable title; that the escrow fee for each property shall be paid <br />one-half by the City and one-half by the purchaser; that the minimum bid shall be <br />$ 26.000 for the property located at 1466 Marlowe Avenue and $ 22~500 <br />for the property located at 1463 Belle Avenue and that the City reserves the right <br />to reject any and all bids or any parts thereof. <br /> <br /> Section 5.
