41-74 Compensation for Clerk of Court

ORDINANCE NO . 41- 74 By: Messrs. Graber, Magnotto, McBride, Sinagra, Usher, Brockman, Chinnock AN MMER~ENCY ORDINANCE fixing the compensation of the Clerk of the Lakewood Municipal Court, the time and method of payment thereof and repealing Section 1 of Ordinance No. 12-74 adopted February 19, 1974. WHEREAS, the Municipal Court Act, Revised Code Section 1901.31 provides that the legislative authority of this municipality shall fix the annual Salary of the Clerk of Courts, and, ~{EREAS, said Act further provides that the compensation of the Clerk shall be paid three-fifths from the City Treasury and two-fifths from the Treasury of the County in which the city is located, and, $~EREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department in that in the interest of publf'c service, welfare and safety, it is necessary to fix the compensa- tion of the Clerk and direct the time and method of payment thereof; now, therefore~ BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the compensation of the Clerk of the Lakewood Municipal Court is hereby fixed at $18,000.00 per annum commencing May 12, 1974. Section 2. That the Director of Finance of the City of Lakewood is hereby authorized and directed to pay three-fifths of the compensation of the Clerk as herein fixed, from the City Treasury in sem~-monthly installments or ~n equal installments every two weeks. Section 3. Th~s ordinance ts hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor and Section 1 of Ordtnanee No. 12-74 adopted February 19, 1974 and all other ordinances or parts of ordinances inconsistent herewith, · hall be and are hereby repealed.
