ORDINANCE NO . 41- 74 <br /> <br />By: Messrs. Graber, Magnotto, McBride, <br /> Sinagra, Usher, Brockman, Chinnock <br /> <br />AN MMER~ENCY ORDINANCE fixing the compensation of the Clerk of the <br />Lakewood Municipal Court, the time and method of payment thereof and <br />repealing Section 1 of Ordinance No. 12-74 adopted February 19, 1974. <br /> <br />WHEREAS, the Municipal Court Act, Revised Code Section 1901.31 provides <br />that the legislative authority of this municipality shall fix the annual <br />Salary of the Clerk of Courts, and, <br /> <br />~{EREAS, said Act further provides that the compensation of the Clerk <br />shall be paid three-fifths from the City Treasury and two-fifths from the <br />Treasury of the County in which the city is located, and, <br /> <br />$~EREAS, this ordinance constitutes an emergency measure providing for <br />the usual daily operation of a municipal department in that in the interest <br />of publf'c service, welfare and safety, it is necessary to fix the compensa- <br />tion of the Clerk and direct the time and method of payment thereof; now, <br />therefore~ <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That the compensation of the Clerk of the Lakewood Municipal <br />Court is hereby fixed at $18,000.00 per annum commencing May 12, 1974. <br /> <br />Section 2. That the Director of Finance of the City of Lakewood is hereby <br />authorized and directed to pay three-fifths of the compensation of the <br />Clerk as herein fixed, from the City Treasury in sem~-monthly installments <br />or ~n equal installments every two weeks. <br /> <br />Section 3. Th~s ordinance ts hereby declared to be an emergency measure <br />for the reasons stated in the preamble hereof and provided it receives the <br />affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval <br />by the Mayor and Section 1 of Ordtnanee No. 12-74 adopted February 19, 1974 <br />and all other ordinances or parts of ordinances inconsistent herewith, <br />· hall be and are hereby repealed. <br /> <br />Acti~ dlerk <br /> <br />Mayor <br /> <br /> <br />
