ORDINANCE NO. 42-74 BYL Messrs. Sinagra, Usher, Brockman, Chinnock <br /> Graber, Magnotto, McBride <br /> AN EMERGENCY ORDINANCE authorizing the Mayor to enter into an <br />agreement granting to the Ohio Bell Telephone Company a perpetual right <br />of way and easement to install, operate, maintain and repair an underground <br />communi'cation system in and upon land owned by the City of Lakewood. <br /> <br /> WHERE~S, the Ohio Bell Telephone Company is currently engaged in a <br />program of modernizing the telephone network throughout the northeastern area <br />of Ohio and is presently engaged in a re-build in the City of Lakewood, and. <br /> <br /> WIIEREAS, the Ohio Bell Telephone Company plans to re-buitd its <br />communications by dedicating cables and equipment to a given geographical <br />area along with b~ilding subterranean conduit systems so that cables may be <br />placed below ground, and <br /> <br /> WHEREAS, the Ohio Bell Telephone Company has requested an easement <br />in property owned by the City of Lakewood for the foregoing purpose and this <br />Council determines that it is in the best interest of the City and its residents <br />to grant the requested easement to the telephone company, and <br /> <br /> WIIEREAS, this Ordinance constitutes an emergency measure providing f(~r <br />the usual daily operation of a municipal department and for the ~.mmediate preser- <br />vation of the public health, safety and welfare, and for the further reason that <br />it is necessary that the company begin its modernization program as quickly as <br />possible; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be and he is hereby authorized and directed <br />to enter into and execute an agreement granting to the Ohio Bell Telephone Company <br />a perpetual right of way and easement to instal]., operate, maintain and repair an <br />underground communicatio~ system in and upon land owned by the City of Lakewood, <br />a copy of which easement is attached hereto and made a part hereof. <br /> <br /> Section 2. That this Ordinance is hereby declared to be an emergency' <br />measure for the reasons stated in the preamble hereof, and provided it receives <br />the affirmative vote of two-thirds of all members <br /> <br />take effect and be in force immediately upon i <br />Mayor. <br /> <br />Adopted: <br /> <br />President <br />Ma~r <br /> <br /> <br />
