ORDINANCE NO. 51-74 <br /> <br />BY: Messrs. McBride, Sinagra, Usher, Brockman, <br /> Chinnock, Graber, Magnotto <br /> <br /> AN EMERGENCY ORDINANCE to amend Section 905.02 of the Streets and <br />Public Services Code of the Codified Ordinances of the City of Lakewood relating <br />to the hours the public parks shall be open to the public. <br /> <br /> WHEREAS, under our present Ordinance, City parks are closed to the <br />general public between the hours of 10:30 p.m. and 7:00 a.m. daily, and <br /> <br /> WHEREAS, the Metropolitan Park and the municipal swimming pools, <br />tennis courts and other special recreational facilities in our parks are permitted <br />to remain open until 11:00 p.m., and <br /> <br /> WHEREAS, the aforementioned inconsistency in closing times for said <br />recreational facilities has resulted in confusion and misunderstanding both by the <br />general public and in the enforcement of these regulations, and which inconsistency <br />should be eliminated in the best interest of the City, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing for <br />the immediate preservation of the public welfare and for the usual daily operation <br />of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 905.02 of the Streets and Public Services Code <br />of the Codified Ordinances of the City of Lakewood now reading as follows: <br /> <br />905.02 HOURS OPEN TO PUBLIC <br /> <br />Parks shall be open daily for use by the general public. However, no <br />person other than an employee of the City shall be permitted within the <br />limits of the parks between the hours of 10:30 p.m. and 7:00 a.m. <br /> <br />be and the same is hereby amended to read as follows: <br /> <br />905.02 HOURS OPEN TO PUBLIC <br /> <br /> Parks shall be open daily for use by the general public; provided <br /> however, no person other than an on-duty employee of the City shall <br /> enter into or remain within the limits of the City parks between the <br /> hours of 11:00 p.m. and 7:00 a.m. <br /> <br /> Section 2. That this Ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives the <br />affirmative vote of two-thirds of all members elected to Cohncil, it shall take <br />effect and be in force immediately upon its a~ion and approval by the Mayor and <br />existing Section 905.02 adopted November 20,/~%shall be a~tHe same is hereby <br /> <br />Adopted: <br /> <br />Approved :~ 4 <br /> <br /> <br />
