ORDINANCE NO. 57-74 BY: <br /> <br />Messrs. Magnotto, McBride, Sinagra, <br />Usher, Brockman, Graber <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Director of Public Works to <br />advertise for bids for the sale of a residential property located at 1466 Marlowe <br />in the City of Lakewood, which property is now owned by the City of Lakewood and <br />determining that it is in the best intersst of the City that said property be <br />sold. <br /> <br /> WHEREAS, the property located at 1466 Marlowe Avenue was originally <br />purchased by the City to be used by Lakewood Hospital for housing single interns <br />and residents, and <br /> <br /> WHEREAS, these progrmns have been eliminated at Lakewood Hospital and <br />the aforementioned property is now only used for minor storage, and <br /> <br /> WI]EREAS, this change in circumstances indicates a desirability to sell <br />the aforementioned residential property which is no longer needed 'for any muni- <br />cipal purpose, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure in that it <br />provides for the immediate preservation of the public health, safety and welfare <br />and for the usual daily operation of a municipal department in that said property <br />should be sold at the earliest possible time; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That this Council determines that the residential property <br />located at 1466 Marlowe Avenue in the City of Lakewood, should be sold and that <br />such sale is in the best interest of the City. <br /> <br /> Section 2. That this Council determines that the sale of the afore- <br />mentioned residential property will further the interests of this City and its <br />residents. <br /> <br /> Section 3. That the Director of Public Works is hereby authorized to <br />advertise for bids for the sale of the residential property located at 1466 Marlowe <br />Avenue and further designated as Permanent Parcel No. 314-7-29. <br /> <br /> Section 4. That said advertisement shall state that any contract for <br /> the sale of said property shall be subject to tile apprOval of Council; that the <br /> conveyance will be by the usual form of warranty deed used by the City and shall <br /> be subject to taxes and assessments, both general nnd special, if any, all of <br /> which shall be prorated as ~of the~date of filing the deeds for record and subject <br /> to restrictions, conditions and reservations of record and zoning ordinances; that <br /> the City will furnish the purchaser or purchasers a title guarantee guaranteeing <br /> a good and marketable~ title; that the escrow fee for each property shall be <br /> paid one-half by the City and one-half by the purchaser; that the minimum bid <br /> shall be $23,500.00 and that' the City reserves the right to reject any and all <br />~bids or any parts thereof. <br /> <br /> Section 5. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its ad°p~andl l ' approvali~i~~fby.,...the,' <br />Mayor. . · · <br /> <br />Approved <br /> <br />Mayor <br /> <br /> <br />
