<br /> AN EMERGENCY ORDINANCE providing for the sale of certain real property
<br />located at 1466 Marlowe Avenue in the City of Lakewood, Ohio.
<br />
<br /> WHEREAS, the said real property (hereinafter described in the body
<br />of the agreement) owned by the City of Lakewood, is no longer needed for any
<br />municipal purposes, and
<br />
<br /> WHEREAS, it is in the best interest of the City of Lakewood that the
<br />said real property be sold, and,
<br />
<br /> WHEREAS, this Ordinance constitutes an emergency measure providing for
<br />the immediate preservation of the public health, safety and welfare and for the
<br />usual daily operation of a municipal department; now, therefore,
<br />
<br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO:
<br />
<br /> Section 1. That it is hereby determined that the real property des-
<br />cribed in the agreement set forth herein is no longer needed for municipal
<br />purposes.
<br />
<br /> Section 2. This council hereby authorizes the sale of said land to
<br />Martin O'Donnell and Anne O'Donnell, husband and wife, and the Mayor is authorized
<br />and directed to execute, on behalf of the City of Lakewood, a contract for the sale
<br />of said property, in substantially the following form:

<br />AGREEMENT
<br />
<br />THIS AGREEMENT made and concluded at Lakewood, Ohio, this day of
<br /> , 1974, by and between the City of Lakewood,.those mailing address
<br />is 12650 Detroit Avenue, Lakewood, Ohio, hereinafter called the "VENDOR" and
<br />Martin O'Donnell and Anne O'Donnell, husband and wife, hereinafter called the
<br />"VENDEES"
<br />
<br />WITNESSETH:
<br />
<br />That in consideration of the mutual promises of the parties herein contained,
<br />the VENDOR agrees to sell and convey and the VENDEES agree to purchase and pay
<br />for, upon and under the provisions, terms and conditions herein expressed, the
<br />following described premises situated in the City of Lakewood, County of Cuyahoga
<br />and State of Ohio:
<br />
<br />Situated in the City of Lakewood, County of Cuyahoga, State of Ohio,
<br />and being known as sublot No. 231 in the Genick Realty Company's
<br />Lakewood Subdivision of parts of Original Rockport Township Section
<br />No. 22 as shown by the recorded plat in Volume 35 of Maps, Page 26
<br />of Cuyahoga County Records, and being 45 feet front on the westerly
<br />side of Marlowe Avenue, 60 feet wide, 120.99 feet deep on the southerly
<br />line, 120.30 feet deep on the northerly line and 45.01 feet in the rear,
<br />as appears by said plat, be the same more or less, but subject to all
<br />legal highways.

<br />and further known as 1466 Marlowe Avenue, together with all buildings>
<br />and appurtenances thereon and appurtenant thereto or thereon in their
<br />present condition.
<br />
<br /> The VENDEES agree to pay for said property the sum of Twenty Six Thousand
<br />One Hundred Fifty-One Dollars ($26,151.00) payable as follows:
<br />
<br /> The VENDOR acknowledges receipt of a certified check in the sum of Five
<br />Hundred Dollars ($500.00) deposited by VENDEES with the proposal to purchase, which
<br />sum shall be applied to the purchase price. The balance of the purchase price shall
<br />be deposited by the VENDEES with the escrow agent, The Cleveland Trust Company,
<br />14800 Madison Avenue, Lakewood, Ohio, 30 days from date of execution of this agree-
<br />ment. .
