ORDINANCE NO. 77-74 BY: Messrs. Chinnock, Graber, Magnotto, McBride, Sinagra, Usher AN EMERGENCY ORDINANCE authorizing the improvement by the City of Maple Cliff Drive, from Lake Avenue to its northerly terminus, by removing the existing surface and resurfacing same with asphaltic concrete, including any appurtenances necessary thereto. WHEREAS, Maple Cliff Drive was last resurfaced in 1940 and is presently in poor condition and in need of repair, and WHEREAS, the equipment acquired by the City is capable of resurfacing said Maple Cliff Drive at a low cost which current estimates indicate will be between $20,000 and $25,000 including chargeable labor costs, and WHEREAS, the owners of the 22 lots bounding and abutting said Drive, not wishing special assessment liens against their property~are each willing to contribute S500 in cash which, in the aggregate, represents approximately one-half of the cost of said improvement and the amount which would otherwise be assessed, and WHEREAS, this Ordinance is hereby declared to be an emergency measure providing for the public health,~safety and welfare and for the usual daily operatic of a municipal department and for the further reason that in view of the continual rise in labor and material costs the City should proceed with said improvement at the earliest possible time; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO': Section 1. That the Department of Public Works of the City of Lakewood is hereby authorized and directed to improve Maple Cliff Drive from Lake Avenue to its northerly terminus by removing the existing surface and resurfacing same with asphaltic concrete, including any appurtenances necessary thereto. Section 2. That the Department of Public Works of the City of Lakewood is authorized to proceed with said project upon the receipt of $500 in cash from each of the 22 property owners bounding and abutting Maple Cliff Drive, which contributions representing approximately one-half of the cost of said project are hereby accepted. Section 3. That the City's share of the cost of said improvement to Maple Cliff Drive Shall be paid out of the Street Construction, Maintenance and Repair Fund. Approved: ~~~ ~A/4~X Section 4.
