Brockman, Chinnock, Graber, <br /> Magnotto, McBride, Sinagra, Usher <br /> <br /> AN EMtSRGENCY ORI)I'NANCE to amend ParagrapII Ca) of Sectio~l 505.02 of tile <br />General Offenses Code of thc Codified Ordinances of t. he City of Lakewood relating <br />to the impounding and disposition of dogs. <br /> <br /> WIIERF, AS, a recent study by tile Po[ice l)cpartmcot indicates that less than <br />6% of all impounded dog,s are claimed on the 4th and 5th days of impoundment, and <br /> <br /> WIIEREAS, the unrecovered cost of impoui~(hn(,nt for thc [,tl~ and 5th days of <br />such impoundment averages $1,100 annually and accounts for approxi~nate].y 35% of <br />total annual impounding costs, and <br /> <br /> WUEREAS, this Council is of the opi. nion that 'it is in the best interest <br />'of the City to reduce the term of impoundment of (lo~.~ from five days ~o three days, <br />which reduction of term would also bring the ordinance of the City into conformance <br />with State Code, and <br /> <br /> WtlEREAS, this Ordinance 'is hereby declar~,d ~"o bo an emergency measure <br />providing for the public health, safety and welfare and for the usual daily opera- <br />tion of a municipal departmen.t; now, therefore, <br /> <br />BE IT' ORDAINED-BY TIlE COUNCIL OF TIIE CITY OF LAKh;WOOI), STATE OF O[[IO: <br /> <br /> Section 1. That Paragraph Ca) of Section 505.02 of t,l~c General Offenses <br />Code of the Codified Ordinances of the City of Lakewood now reading as follows: <br /> <br />505.02 IMPOUNDING AND DISPOSITION; RECORDS <br /> <br />Ca) <br /> <br />A police officer or an[mai ward(m shall impound every animal or dog <br />found in ,violation of Section 505.O1. If thc impounded clog is not <br />wearing a valid registrati, on tag, the do}.~ shall fo~thwitl~ be turned <br />over to an officer clmrged by law with the custody and di. sposal of <br />suc}~ dogs. If the dog is wearing a valid rcgistrat[,on tag or the <br />identity of the owner or harborer J s otherwise establi, shed, notice <br />shall be given within two days to sucl~ owner or harborer that the <br />dog has be6n iml)olmded. Not'ice may bc by telephone or by ordinary <br />mail to the last known address of s~ch ow,er or harborer. The dog <br />shall not be rel. eas~d except upon the payment of tl~e following <br />charges: for impounding a~y dog, tl~ree dollars ($3.00); for giving <br />notice, three dollars ($3.00); for keeping any dog, three dollars <br />($3.00) per day.
