ORDINANCE NO. 81-74 <br /> <br />BY: Messrs. Chinnock, Magnotto, McBride, <br /> Sinagra, Usher, Brockman <br /> <br /> AN EM]~RGENCY ORDINANCE authorizing the Director of Public Works to <br />enter into a contract with the City of Warren, Ohio to purchase one VacMaster <br />leaf qollection machine together with three closed collection boxes and necessary <br />appurtenances thereto. <br /> <br /> WHEREAS, in 1969 the City of Warren, Ohio purchased a VacMaster leaf <br />collection machine for approximately $20,000, which machine did not meet the needs <br />of the City of Warren as its leaves are collected from ditches rather khan paved <br />surfaces, and <br /> <br /> WHEREAS, the VacMaster machine purchased by the City of Warren, Ohio is <br />identical to equipment now owned and used by the City of Lakewood, and <br /> <br /> WHEREAS, present equipment of the City is not capable of handling the <br />leaf collection for 'the City and it would be in the best interest of the City to <br />purchase additional equipment, and <br /> <br /> WHEREAS, the Ci'ty of Warren, Ohio is willing to sell its VacMaster leaf <br />collection machine to the City of Lakewood for the sum of $10,000, which price <br />represents a substantial savings to the City, and <br /> <br /> WHEREAS, pursuant to Ohio Revised Code 735.053, the legislative authority <br />of a municipal corporation may enter into a contract for the purchase of equipment <br />from another political subdivi, sion of the State without advertising and competitive <br />bidding, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing for <br />the immediate preservation of the public health, safety and welfare and for the <br />usual daily operation of a municipal department and for the further reason that <br />said equipment should be purchased at the earliest possible time; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Director of Public Works is kereby authorized and <br />directed to enter into a contract with the City of Warren, Ohio to porchase one <br />VacM~ster leaf collection machine together with three closed collection boxes and <br />the necessary appurtenances thereto for an amount not to exceed $10,000. <br /> <br /> Section 2. That there is hereby appropriated from the Equipment Rental <br />Fund an amount not to exceed $10,000 to be paid as the purchase price for said <br />equipment. <br /> <br /> Section 3.
