ORDINANCE NO. 84-74 <br /> <br />BY: Messrs..Graber, Magnotto, McBride, <br /> Sinagra, Usher, Brockman, Chinnock <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor to employ <br />by contract the firm of The Walter H. Drane Co. for the purpose of recodifying <br />and printing the Traffic Code of the Codified Ordinances of the City of Lakewood. <br /> WHEREAS, it is necessary to recodify the Traffic Code of the Codified <br />Or'dinances of the City of Lakewood to conform to current State law, including <br />Am. Sub. House Bill 995 effective January 1, 1975, and <br /> WHEREAS, this Council determines the necessity to employ the services <br />of The Walter H. Drane Co. to .complete such codifying and printing, and <br /> ~WHEREAS, this Ordinance constitutes an emergency measure providing <br /> for the immediate preservation of the public health, safety and welfare and for <br /> the further reason that the new State Traffic Code becomes effective January 1, <br /> 1975 and the Codified Ordinances of the City should be conformed to State law <br /> by that date; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL oF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1~ That the Mayor be and he is hereby authorized and directed <br /> to employ by contract the firm of The Walter H. Drane Co. for the purpose of <br /> codifying and printing the Traffic Code of the Codified Ordinances of the City <br /> of Lakewood, said contract to provide for a fee of $1,900.00, and to be in <br /> substantially the following form: <br /> <br />AGII I'] EMEN T <br /> <br /> An agTecment cntcrcd into bctwcen the Municipality of Lakewood, ()hie hereinafter <br />called the Mtmtctpality, and The Walter ii. Drane Company, an Ohio corporation, here- <br />inafter called the Contra.ctor. <br /> <br /> WtlEREAS, the Municipality desires Ix) recodify its Traffic Code to con[erin to current <br />State law (including Am. Sub. llouse Bill 995, e££eetive January 1, 1975), m~d to include <br />local provisions enacted to date, <br /> <br /> wtlEREAS, the Contractor i:s skilled in codification m~d ordinance indexing and editing, <br />and is organized to render such services. <br /> <br /> NOW, TIIEi~EIrOP~E, in consideration of their mutual Promises and covenants, 'the <br />parties agree: <br /> <br />A. The <br /> 1. <br /> <br /> Contractor shall render fl~e Municipality the [ollowing' services: <br /> Cedi[y, edit and index a component code D be known as Part Three - Wraffie Code <br /> to conform to current S~zte law. <br /> g. Examine m~d review the provisions contained in tho present Tra.[[ic Code to <br /> ascer¢~n material suitable for co~ficafion and which will not con[lict with current <br /> State laxv. <br /> 3. Screen all subsc~luent amendments enacted by Council lo da're. <br /> 4. Confer with the Law Director or Solicitor as may bo necessary to submit suggesNons <br /> as to delc~ons, modi[icatlons and additions to the current ortHnance material ~ <br /> conform to thc current shttutes of the S~tc of Ohio. <br /> 5. Print and deliver totho Municipality 100 copies of tho' Tra[l'ic Code for the Codified <br /> O.rdhmnces and I00 copies tot tho Police Books, wit:h'a separate index there,, in a <br /> form and style similar to the present CodJ.~ed Ordinances. <br /> 6. Correct all Tra[fie Code cross references contained in Lhe CotHfied Ordinances ~ <br /> conform to the pro~Ssions et tim revised Tra[gc Code and print and deliver to the <br /> M~icipaHty 100 copies et such corrected pages. <br /> <br />B. The Municipality shall pay the Contractor $1900.00 for its services rendered in Part <br /> A, payable ~tt~n ten days alter receipt of the printed copies of tim new Tr~[ic Code. <br />IN WITNESS WHEi{EOF, the parties have set their hands the day and da~ below written. <br /> <br />SIGNATURES <br /> <br /> <br />
