ORDINANCE NO. 37-75 <br /> <br />BY: Messrs. Brockman, Graber, Chinnock, <br /> Magnotto, McBride, Sinagra, Usher <br /> <br /> AN EMERGENCY ORDINANCE prohibiting persons to enter or remain on the <br />premises of the City of Lakewood situated generally north of Madiso~ Avenue, <br />east of Rocky River and west of Riverside Drive. <br /> <br /> WHEREAS, that area of the City situated west of Riverside Drive and <br />East of Rocky River from Madison Avenue, north to land owned by the Board of <br />Park Commissioners, is hazardous and dangerous to those persons who would enter <br />said area because of severe eroding conditions and the steepness of the bank of <br />said property, and <br /> <br /> WHEREAS, this Council determines that it is in the best interest of the <br />safety and welfare of the general public that no person should be permitted to <br />enter or remain in said area for their own personal safety unless specifically <br />authorized to do so, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health, safety and welfare and for <br />the further reason that the public should be prohibited from going into said area <br />at the earliest possible time; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. No person shall enter or remain on the land owned by the <br />City of Lakewood, bounded and described as follows: <br /> <br />Situated in the City of Lakewood, County of Cuyahoga and State <br />of Ohio and being bounded on the west by the easterly bank of <br />Rocky River, bounded on the east by the westerly line of Riverside <br />Drive, hounded on the south by a line which is the extension of <br />the center line of Madison Avenue (which line is also the northerly <br />boundary of a parcel of land owned by the State of Ohio) and forming <br />an arc in a northwesterly direction along the easterly line of <br />Rocky River to the boundary of a certain parcel of land owned by the <br />Board of Park Commissioners, the aforesaid premises being further <br />known as Permanent Parcel No. 313-1-3 of the Records of Cuyahoga <br />County. <br /> <br /> Section 2. The prohibition provided in Section 1 hereof shall not <br />apply to on-duty employees of the City of Lakewood nor to other persons as may <br />be authorized to enter said area by the Director of Public Works. <br /> <br /> Section 3. The Director of Public Works is hereby authorized and <br />directed to erect appropriate signs giving notice of prohibition, as set forth <br />in the within ordinance, at such places as shall be selected and determined by <br />said Director of Public Works. <br /> <br /> Section 4.
