ORDINANCE NO. 54-75 <br /> <br />BY: Messrs. Usher, Brockman, Chinnock, <br /> G~aber, Magnotto, McBride <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Director of Public Safety to <br />enter into a contract with Stahl Metal Products Company to purchase one Alarm <br />Truck for the Division of Fire. <br /> <br /> WHEREAS, the shifting mechanism of the Alarm Truck used by the Division <br />of Fire has broken down and due to its age the City has been unable to obtain <br />necessary replacement parts, and temporary repairs presently permit said Truck <br />to be used in a very limited capacity, and <br /> <br /> WHEREAS, the Stahl Metal Products Company, 4750 West 160th Street, <br />Cleveland, Ohio is willing to sell a similar Alarm Truck to the City of Lakewood, <br />which said Company has been using as a demonstrator and is a late model Alarm <br />Truck with low mileage and in good condition, for the price of $8,100, and <br /> <br /> WHEREAS, pursuant to Ohio Revised Code 735.051 the legislative authority <br />of a municipal corporation may, by a two-thirds vote, contract for the purchase of <br />equipment without formal bidding and advertising in the case of a real emergency <br />arising in connection with the operation and maintenance of the Department of <br />Public Safety, and <br /> <br /> WHEREAS, a real and present emergency exists in the usual daily operation <br />of the Division of Fire of the City of Lakewood in that said Alarm Truck is <br />immediately available to carry on emergency fire alarm circuit maintenance without <br />the delay of awaiting a delivery time and it is immediately necessary to enter <br />into a contract for the aforesaid equipment for the immediate preservation of the <br />public health, safety and welfare; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Director of Public Safety is hereby authorized and <br />directed to enter into a contract with Stahl Metal Products Company to purchase <br />one used Alarm Truck for an amount not to exceed $8,100. <br /> <br /> Section 2, That there is hereby appropriated from the Federal Revenue <br />Sharing Fund an amount~not to exceed $8,100 to be paid as the purchase price for <br />said Alarm Truck. <br /> <br />Approved: <br /> <br /> Section 3.
