ORDINANCE NO. 59-75 BY: <br /> <br />Messrs. Chinnock, Graber, Magno'tto, <br />McBride, Sinagra, Usher, Brockman <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Director of Public <br />Works, on behalf of the City of Lakewood, to enter into an agreement with the <br />Lakewood Board of Education to provide for the control, maintenance and operation <br />of the new Winterhurst Ice Rink located at 14740 Lakewood Heights Boulevard, <br />Lakewood, Ohio and repealing other ordinances inconsistent herewith. <br /> <br /> WHEREAS, the new ~interhurst Ice Rink located at 14740 Lakewood Heights <br />Boulevard, Lakewood, Ohio will be completed in the immediate future for recrea- <br />tional purposes', and <br /> <br /> WHEREAS, Ohio Revised Code 755.16 authorizes a municipal corporation to <br />operate and maintain recreational facilities jointly with a school district, and <br /> <br /> WHEREAS, this Council determines it to be in the best interest of the <br />City to enter into an agreement with the Lakewood Board of Education for the <br />joint operation of said Ice Rink, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing for <br />the immediate preservation of the public health and welfare and the usual daily <br />operation of a municipal department and for the further reason that provision <br />should be made for the operation of the new Winterhurst Ice Rink at the earliest <br />possible time; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Director of Public Works be and he is hereby <br />authorized and directed to enter into an agreement with the Lakewood Board of <br />Education for the control, maintenance and operation of the new Winterhurst Ice <br />Rink located at 14740 Lakewood Heights Boulevard, Lakewood, Ohio, said agreement <br />to be substantially in the form of the agreement attached hereto and made a part <br />hereof as if fully rewritten herein and marked Exhibit "A". <br /> <br /> Section 2o That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hemeof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />aM~°~a~~ ~d'~.~n~6~n~~e~P~~F~ha~164b~n~n~l~t~e°~n~y <br />repealed.
