ORDINANCE NO. 66-75 BY: Messrs. Brockman, Graber, Magnotto, Sinagra, Usher AN EMERGENCY ORDINANCE to enact new Chapter 109 of the Administrative Code of the Codified Ordinances of the City of Lakewood pertaining to public meetings. WHEREAS, Senate B~ll 74 adopted by the Ohio State Legislature became effective November 28, 1975, and WHEREAS, said Scnate Bill 74, mor.e conm~on[y known as the "Sunshine Law" requires that all meetings of any. public body be open to the p~blic at all times, and provides further that municipalities shall establish by rule a reasonable method whereby persons may determine the time and place of such meetings, and WHEREAS, this Council is desirous of c~nplying with the new law as established by the State Code, and WHEREAS, this Ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department and for the further reason that it is necessary to comply with the applicable State Law at the earliest possible time; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Part One, the Administrative Code of the Codified Ordinances of the City of Lakewood, shall be and the same is hereby supplemented by enacting new Chapter 109 to read as follows: CHAPTER 109 Public Meetings 109.01 PUBLIC MEETINGS Unless otherwise provided in the Codified Ordinances, all meetings of Council, the Board of Building Standards m~d Building Appeals, the Board of Zoning Appeals, the Board of Control, Civil Service Commission, the Planning Commission, the Senior Citizens Advisory Committee, the Citizens Advisory Committee on CD Block Grants and other similar' public bodies of the City or other citizens' committees as may be appointed from time to time, shall be open to the public, unless art executive session is expressly authorized under the appli- cable provisions of State Law. Nothing herein contained shall mandate that any public body permit public participation in such meetings unless specifically required by the provisions of the Amended Charter of the Codified Ordinances. 109.02 PUBLIC NOTIFICATION (a) Regular Meetings The time and place of all regular meetings of public bodies desi~nated in Section 109.01 hereof, shall be noted in a calendar of anmlal meetings. This calendar shall be posted in the office of the Clerk .of Council at City Hall and those posting places est~blisbed in. Section 107.01 of this Code not later than the second day preceding the day of the first regular meeting of the cale~dar yea'r of that public body. (b) Notif:ic:*i:ic~ ,'* ,qny special meeting of the public bodies designated in f;cct'io, l(')q.fl! hereof shall be given to any news media requesting s,.cb notification tw~-'nty-four (24) hours prior to the time of such meeting. This notification shall include the time and place and purpose of the sr,c~r'~;-*l meeting.
