ORDINANCE NO. 66-75 BY: <br /> <br />Messrs. Brockman, Graber, Magnotto, <br />Sinagra, Usher <br /> <br /> AN EMERGENCY ORDINANCE to enact new Chapter 109 of the Administrative <br />Code of the Codified Ordinances of the City of Lakewood pertaining to public <br />meetings. <br /> <br /> WHEREAS, Senate B~ll 74 adopted by the Ohio State Legislature became <br />effective November 28, 1975, and <br /> <br /> WHEREAS, said Scnate Bill 74, mor.e conm~on[y known as the "Sunshine Law" <br />requires that all meetings of any. public body be open to the p~blic at all times, <br />and provides further that municipalities shall establish by rule a reasonable <br />method whereby persons may determine the time and place of such meetings, and <br /> <br /> WHEREAS, this Council is desirous of c~nplying with the new law as <br />established by the State Code, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing for <br />the usual daily operation of a municipal department and for the further reason <br />that it is necessary to comply with the applicable State Law at the earliest <br />possible time; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Part One, the Administrative Code of the Codified <br />Ordinances of the City of Lakewood, shall be and the same is hereby supplemented <br />by enacting new Chapter 109 to read as follows: <br /> <br />CHAPTER 109 <br />Public Meetings <br /> <br />109.01 PUBLIC MEETINGS <br /> <br />Unless otherwise provided in the Codified Ordinances, all meetings <br />of Council, the Board of Building Standards m~d Building Appeals, <br />the Board of Zoning Appeals, the Board of Control, Civil Service <br />Commission, the Planning Commission, the Senior Citizens Advisory <br />Committee, the Citizens Advisory Committee on CD Block Grants and <br />other similar' public bodies of the City or other citizens' committees <br />as may be appointed from time to time, shall be open to the public, <br />unless art executive session is expressly authorized under the appli- <br />cable provisions of State Law. <br /> <br />Nothing herein contained shall mandate that any public body permit <br />public participation in such meetings unless specifically required <br />by the provisions of the Amended Charter of the Codified Ordinances. <br /> <br />109.02 PUBLIC NOTIFICATION <br /> <br />(a) Regular Meetings <br /> <br />The time and place of all regular meetings of public bodies <br />desi~nated in Section 109.01 hereof, shall be noted in a calendar <br />of anmlal meetings. This calendar shall be posted in the office <br />of the Clerk .of Council at City Hall and those posting places <br />est~blisbed in. Section 107.01 of this Code not later than the <br />second day preceding the day of the first regular meeting of <br />the cale~dar yea'r of that public body. <br /> <br />(b) <br /> <br />Notif:ic:*i:ic~ ,'* ,qny special meeting of the public bodies designated <br />in f;cct'io, l(')q.fl! hereof shall be given to any news media requesting <br />s,.cb notification tw~-'nty-four (24) hours prior to the time of such <br />meeting. This notification shall include the time and place and <br />purpose of the sr,c~r'~;-*l meeting. <br /> <br /> <br />
