ORDINANCE NO. 70-75 BY: <br /> <br /> AN ORDINANCE to supplement Chapter 1123 General Provisions of the <br />Zoning Code of the Codified Ordinances of the City of Lakewood by enacting new <br />Section 1123.14 to provide for church-related uses as a special exception in <br />all diStricts contiguous' with the B-2 Retail District, provided certain con- <br />ditions are met. <br /> <br />BE IT ORDAINED BY TItE COUNCIL OF TIlE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Chapter 1123 General Provisions of the Zoning Code <br />of the Codified Ordinances of the City of Lakewood be and the same is hereby <br />supplemented by enacting new Section 1123.14 to read as follows: <br /> <br />1123.14 SPECIAL EXCEPTIONS <br /> <br />The following uses if approved by the Board of Zoning Appeals <br />after public notice and public hearing may be permitted as a <br />special exception provided that the conditions hereinafter <br />specified are met: <br /> <br />.(a) <br /> <br />Church buildings including Church educational buildings, <br />parish houses, church offices, recreational facilities <br />and off-street parkfng for 'church uses only, provided: <br /> <br />(1) <br /> <br />The parcel of land for which the special exception <br />is requested must be contiguous to a parcel classified <br />Retail District B-2 under the provisions of this Code. <br /> <br />(2) No building, or portion thereof, permitted hereunder <br /> shall be used to conduct a buisness open to the public. <br /> <br />(3) <br /> <br />The side yard between the church building and the lot <br />line of the abutting residential lot shall be not less <br />than 10 feet. <br /> <br />(4) <br /> <br />The zoning regulations of the district in which this <br />special exception is being fequested shall apply to <br />the building proposed. <br /> <br />(5) <br /> <br />Notice by ordinary mail of the public hearing provided <br />for herein shall be given to the owner or owners of all <br />property located within two hundred (200) feet of the <br />property for which the special exception is requested. <br /> <br />(6) <br /> <br />The Board of Zoning Appeals may prescribe conditions <br />with respect to construction, maintenance, fences, walls, <br />off-street parking, driveways, landscaping, signs and <br />such other conditions it deems necessary to protect the <br />general welfare of the co~mnunity and the character of <br />the neighborhood. <br /> <br /> Section 2.
