Please substitute for Ordinance No. 17-76 <br />which Ordinance was placed on first reading <br />on Marcb 15, 197~6 and on second reading at <br />meeting held April 5, 1976. <br /> <br />ORDINANCE NO. 17- 76 BY: <br /> <br />Messrs. Usher, Salmon, <br />Brockman, Chinnock, Magnotto <br /> <br /> AN ORDINANCE to supplement Section 1119.04 of the Zoning Code of the <br />Codified Ordinances of the City of Lakewood by enacting new Paragraph (d) thereto <br />to permit animal hospitalS as a special exception in a Retail District B-2 provided <br />certain conditions are met: <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 1119.04 of the Zoning Code of the Codified <br />Ordinances of the City of Lakewood shall be and the same is hereby supplemented <br />by enacting new Paragraph (d) thereto to read as follows: <br /> <br />1119.04 Special 'Exceptions <br /> <br />The following uses may be permitted as a Special Exception by the Board <br />of Zoning Appeals when the standards and conditions specified herein <br />are complied with. In the granting of a Special Exception, the Board <br />of Zoning Appeals may presceibe such additional conditions and safeguards <br />as it deems necessary, desirable or appropriate. The Board may vary the <br />standards specified for land area and minimum dimensions for an exception <br />when it finds, (1) it is unreasonable for the applicant to acquire more <br />land, (2) the land is suitable for the proposed use, (3) the proposed <br />use will not be detrimental to the neighborhood. <br /> <br />(d) <br /> <br />Animal hospitals upon compliance with the following terms and <br />conditions: <br /> <br />(1) The animal hospital shall comply with and meet the standards <br /> established by the American Animal Hospital Association or <br /> its successors. <br /> <br />(2) <br /> <br />For each Doctor of Veterinary Medicine practicing at said <br />hospital there shall be five (5) off-street parking spaces <br />provided. <br /> <br />(3) No outside animal runs or cages shall be permitted. <br /> <br />Adopted: ~ /'~/ /~. 7~ <br /> <br /> Section 2.
