ORDINANCE NO. 50- 76 BY: <br /> <br />Messrs. Usher, Brockman, Magnotto, <br />McBride, Sinagra <br /> <br /> AN EMERGENCY ORDINANCE enacting new Section 549.21 of the General <br />Offenses Code of the Codified Ordinances 'of the City of Lakewood relating to <br />the sale, possession and use of dangerous toys. <br /> <br /> WHEREAS, the Police Department has been receiving a number of <br />complaints from citizens regarding juveniles using air rifles and other <br />dangerous toys within the City, and <br /> <br /> WHEREAS, at the time our new General Offenses Code was adopted the <br />section relating to the possession of dangerous toys was not included in the <br />new code, and <br /> <br /> WHEREAS, this Council is of the opinion that legislation should be <br />adopted to prohibit the sale, possession and use of dangerous toys within the <br />City, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing <br />for the immediate preservation of the publ%c health, safety and welfare and <br />for the usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT. ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the General Offenses Code of the Codified Ordinances <br />of the City of Lakewood be supplemented by enacting mew Section 549.21 to read <br />as follows: <br /> <br />549.21 SALE, POSSESSION AND USE OF DANGEROUS TOYS <br /> <br />(a) <br /> <br />No person, firm or corporation shall, within the City, <br />sell, offer for sale or have in his or its possession <br />or custody any sling shot, bow and arrow, blow gun or <br />other contrivance for throwing stones, pebbles, pellets, <br />spears, arrows or other missiles. For the purpose of <br />this section, possession of any of the foregoing in an <br />organized and regularly established gallery or range <br />shall be prima facie lawful. <br /> <br />Any police officer who finds any minor violating the <br />provisions of this section is hereby authorized to take <br />possession of such weapons or toys and to retain the <br />same until such time as the parent or guardian of such <br />minor makes application therefor to the Chief of the <br />Division of Police. <br /> <br />(b) Whoever violates this section is guilty of a minor <br /> misdemeanor. <br /> <br /> Section 2. That this Ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two~thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor. <br /> <br />Adopted: <br /> <br />Approved:~~ ~/ /~? ~?~i <br /> <br />Clerk <br /> <br />Mayor <br /> <br /> <br />
