ORDINANCE NO. 61-76 <br /> <br />BY: Messrs. Chinnock, Magnotto, McBride, <br /> Salmon, Sinagra, Usher, Brockman <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Director of Public Works to <br />rent the necessary machinery and labor from G & R Sewer Construction Co., at <br />an hourly rate, for repairs to a storm sewer in Madison-Avenue at Lakeland <br />Avenue. Said rental shall not exceed a total amount of $14,000. <br /> <br /> WHEREAS, on or about August 23, 1976 it was determined that there <br />was a structural failure of a brick arch storm sewer in Madison Avenue at <br />Lakeland Avenue which created a real and present emergency, and <br /> <br />WHEREAS, immediate repair was mandatory, and <br /> <br /> WHEREAS, pursuant to Ohio Revised Code Sec. 735.051 the legislative <br />authority of a municipal corporation may by a two-thirds vote contract for work <br />to be done or for the purchase of supplies or materials without formal bidding <br />and advertising in the case of a real and present emergency arising in connec- <br />tion with the operation and maintenance of a department of the municipal corpora- <br />tion, and <br /> <br /> WHEREAS, a real and present emergency exists in the usual daily operation <br />of the Department of Public Works of the City of Lakewood in that immediate repairs <br />are necessary to said storm sewer and that it is immediately necessary to enter <br />into a contract for such repairs for the immediate preservation of the public <br />peace, property, health and safety; now, therefore, <br /> <br />BE IT ORDAINED B~ THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That payment be made to the G & R Sewer Construction Co. <br />at an hourly rental for machines and labor in a total amount not to exceed <br />$14,000 for the repair of the Madison Avenue storm sewer at Lakeland Avenue. <br /> <br /> Section 2. That the Director of Finance be, and he is hereby directed <br />to pay hourly rental rates in a total amount not to exceed $14,000 to the G & R <br />Sewer Construction Co. for repairs to the Madison Avenue storm sewer at Lakeland <br />Avenue, and that said sum be charged to the Waste Water-Sewer Facilities Fund. <br /> <br />Approved:~~~7 ~ /~7~ <br /> <br /> Section 3. That this Ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adop.
